K1 visa interview in Singapore: Do I have enough evidence of support?

Hi everyone,

My fiancé and I just realized we do not have a W2 form, and are wondering if this will have any implications during the interview at the US Consulate in Singapore. For those who have been interviewed, could you let me know if what I'm bringing is enough so I don't get a 221(g)? The following documents are:

  • his 2011 and 2012 U.S Individual Income Tax Return forms (completed by his accountant and submitted to IRS)
  • one bank statement from MidFirst bank dated July 31, 2013
  • one consolidated bank statement from Chase indicating one checking and one savings account for July 13, 2013 through August 13, 2013
  • a Total Rewards statement of contribution by employer (base salary, reward and recognition etc.) for 12-month period ending June 30, 2013
  • two latest online paychecks back-to-back

My fiancé is definitely earning above the poverty guidelines. I'm just concerned that the CO might still think that there are not enough supporting documents. Any thoughts?

A W2 form is not listed on the I-134 form or in the instructions, and is not on the list of supporting documents, I think you'll be fine as long as you have the "B. Statement(s) from your employer on business stationery showing:

1.Date and nature of employment;
2.Salary paid; and
3.Whether the position is temporary or permanent"

I looked in my documents left over from the interview and realised that I still have the income docs they rejected.. They returned the W2 slips for 2011/2012 (but they were back to back, so they might have missed out the 2012 piece, I don't know), as well as income tax returns for 2011 (might have been a duplicate copy). So they did take the bank statement printout that was without a bank officer's signature =p

this financial stuff is starting to scare me with the interview in just over a week. dwinge and hobbit, if you are still lurking, could i get a second set of eyes to look over the evidence of support i'll be bringing with me?

1. W2s for 2010 and 2011, all above poverty guidelines

2. 3 different W2s for 2012 which add up to above poverty guidelines

We don't have 1040s. For income this year (2013), it's a little trickier cos we don't even have any w2 forms yet and he's had three employers, one of which is recent. We have:

3. last paystub from job A showing earnings from january to june 2013

4. bank statements showing some of the direct deposits (net income) from job B over july to september 2013

5. copy of the offer letter from his current job on business stationery stating the start date (21 oct 2013) and pay on a bi-weekly basis (comfortably above the poverty guidelines) (does not say whether it's a temp/permanent position though)

6. earnings statement for the first week of his current job stating hourly rate and number of hours worked (40 hours that week)

no. 3-6 add up to *barely* above the poverty guidelines mostly because our proof for earnings in job B are lacking. any ideas if this is sufficient or if i should be worrying? he has a great job now and current income is just fine, but i'm also aware it's a new job and will carry less weight than a long-held position.

thanks in advance for your help.

Just stumbled upon this...hope I'm not too late! I can't say for sure if it's enough, because I did send in rather different documents- had no W2s but Forms 1040. My only concern is that the letter of offer isn't equivalent to a letter stating that he has taken the job. My advice would be to speak directly to the Embassy folks and tell them this is what you've got. The guy who usually answers the phone will let you know if the documents you've stated are enough.

Let us know how it goes! :)

Thanks for the reply hobbit and I hope everything's going well with AOS! I also posted here where there are a few more comments/replies. We're now trying to get the 1040s/ITRs in person at his local IRS office, and as a last resort, will submit them to the embassy after the interview, if needed. Basically there was a mixup where my fiance thought the W2s *were* his ITRs and I only realised they were missing when I got the papers in the mail. Gotta love my silly man. <3 I'll update once the interview is over. Fingers crossed! :)

It happened the same to me. When my finace is about to send off his mail, he called me and tell me the list of things he was going to send. I asked him " where is your ITR?" He asked me what is ITR, I thought ITR was W2. It's NOT the same.

He ordered it from the IRS and hopefully we will get it in a couple of days so he can send the mail off. Good luck for your interview, do write back and let us know how it goes.
