N-400 denial because of immigration error!!!

At harpa the IO told me I was approved on 4.20.2010 which was my interview date and told me I would get my card in the mail but I didn't get it until 9months later.i made numerous info pass but there famous words are wait such and such time and get back to us.the lady that interview me for the citizenship said the guy that did the previous interview forgot to put my approval date in my file but I'm guessing it was approved in the system the day I had the interview.i would understand if he had told me that,well I can make any decision on your greencard but he told me I was approved

So this was my point - did it take nine months to be approved or nine months to simply get the card? OP needs to establish when approval happened.

What exactly was the mistake the interviewing officer made? Was the mistake to delay approval for nine months? In which case, the OP is out of luck in terms of her current timeline.

Or was the mistake to put the wrong approval date on the file - ie it should have been the interview date or near to it.

Either way they have admitted some sort of mistake so I'd hope there was some grounds for a fee waiver or an expedite when you apply again - not sure if that is possible though.

I asked what status I was in and she said she dont kno until she get her legal team to look at the same but since I had the 10 year I should continue using it.alson on my greencard it says on the category "IR6" which means immediate relative,I'm not an immediate relative to my husband,lol.so they messed that part up too.i didn't even know what that meant before she pointed that out and told me he had that part wrong also. Basically what she is saying @Morningmist,when I filed to remove the i765 the 2year condition from my greencard I filed that part too early,so that part would also be denied with my citizenship. So everything after my 2year greencard is denied.they didn't see there mistake when I removed the 2years but now since I got the citizenship interview,all there mistakes are showing.do u get what am saying,I know it's complicated and that's y am just waiting on the denial letter and the attachment she's aid she would put to explain that it was there fault blah blah

I was approved on 4.20.2010 @Lynee. The IO officer that interviewed me told me I would get the card in the mail but I didn't get it until 9months later,when I got the card the approval date on the card was my interview date 4.20.2010 so I thought nothing of it because he told me I was approved that day but I'm guessing when they sent the card out he realized that he didn't put my interview approval date on it and wrote in my file that the approval date was when my card actually got mailed out. He didn't bother to go through my file to put my actual approval date.so all I got was I'm sorry,he was new and didn't know what he was doing and my interview got denied.i asked her y did I even get an interview,she said well because every n400 that's filed is obligated to get an interview,although she saw the error prior to me coming to the interview that day.did the swear in,answered all the questions right,went through the application and then she denied me because she see where he put the wrong date.the 4.20.2010 is in the system but the date he wrote down on my file was 9months later.that could have been an easy fix but I guess they don't really want anyone to know about there mistake and denied me. It's complicated and I'm drained just talking about this but I'm here to enlighten other people who is in similar situation and to also get advise. immigration do make mistake but you have to pay for it,literally.....

A verbal approval does not mean anything until the online case status changes and you receive the green card. I was told I was approved at my second interview in early March, but the online status did not change until April at which point I actually received the green card, and sure enough the "Resident Since" date is also April.

You can try to appeal, and are entitled to a hearing on your N-400 denial as a matter of course, but I don't think you will get anywhere with it, because USCIS were correct to deny your application due to insufficient time as an LPR. Your LPR status only begins once the green card is actually issued, and I think that is the crux of the issue here.

Hypnos that's not true about the online status.online status hardly gets updated and if I had gone solely off online status I would still be in initial review stage. some people got there card and there online status never changed. Well I'm gonna fight this even though you think it won't get anywhere,it's my right and I did nothing wrong on my date,they should have there stuff sorted out before they sent it to me. Uscis was not correct on denying me because of there mistake.its like you got pulled over by the cop and got a ticket to pull over,how would the the police be right in that situation,how would the person would know not to pull over.if u get what am saying.i filed the time that's on my greencard and am not psychic to know that in there file they made an error and the person who they employed messed me n 100s of other cases

How do you know this IO isn't wrong and she is the one looking at the wrong box? Your card went into card production twice. How did they come up with 4.20.2010 twice without looking at the right box? Your paperwork has exchanged so many hands and no one noticed the date until now? Also no one during ROC noticed that whooping 9 month gap? She said that the initial IO was wrong, but was he? She did let you keep your GC and since she isn't sure about your status, I would get a lawyer and appeal.

I got verbal approval too on the spot and I did specifically ask what my current status was during the interview. My IO said prior status was void current is PR. I asked her what do I tell the folks at work tomorrow and she said I could keep my EAD until I get my GC. My date on my GC is also on the interview date and not the date of when my online status changed.

What should it have been? Didn't you get GC based on marriage to a USC? that makes you an immediate relative? And if you had interview here in the US it means you did an AOS, so I would think that is the right category if you did ROC? And she said that was wrong too?

@morningmist ,that's exactly what am thinking ,9months gap n nobody saw that.the thing is the date I got the interview that's the date in the system,the only thing is causing all this is because he wrote a different date on a piece of paper and she saw that paper n denied me.yes she did let me keep the greencard,even thou she pointed out that I even had a wrong category on my card. The IO had my category as immediate relative.so he messed up both my date and category,lol.wow.

So I think the first step is to see if you can get confirmation of exactly what your approval date was.

And what exactly was the first officer's mistake? This mistake that he had done to many other people too.

Why did it take 9 months from interview to Green card production?

If they say that the approval date was the one nine months later - why? And why did the Greencard end up with the earlier date on it?

She was the approval date that the first IO gave me was on my interview date but he forgot to actually put the approval date after the interview.that IO was so mean n u professional,I knew something wasn't right with them. When she said well to make you feel better he did this to 100s of people's case not just yours.i told her he was pretty mean and she said yea heard that already n laughted but anyways she said he approved me on the date of the interview so am not sure what happened,I'm just clueless n feel lost. I was asking so if he messed up so many cases what was done in there cases,she was like I can't give out personal information on other case but she just told me he messed up other cases,so what's so personal about advising me what to do that other people probably did to get over this.im guessing they didn't want me to do anything and just refile and pay more money

You are an immediate relative of a US citizen. A spouse ( husband or wife) is considered immediate relative and technically IR6 on a 10 year GC is correct. on the Conditional it would be CR6. Check out this link:

So the initial IO put IR6 on your conditional GC is that what she said? Or did she point to the 10 year and she said that?

I would have to check back on both cards but she highlighted something about wrong category and it should not be ir6 ,I had no idea about category until she told me the wrong category was on it.so I'm thinking from what she's saying if my father or mother was a U.S citizen,I would be an immediate relative but if my husband filed,I wouldn't be his immediate relative.thats kinda how it seemed but she didn't go in details that much because she wanted to move on to the next interview .
