Worried about Cr-1 application

Hello everyone,

I am from the Philippines, i just got married recently, few weeks ago.

Now once i get the copy of our NSO Marriage Certificate by next week

my husband will start filing for the Cr-1 or the spouse visa which they say is much appropriate for us two..

I have a son who is 6 years old.

I am worried, cause he filed for a k-1 last january for someone else.

To cut the story short, he filed for someone after we had some mis understandings. Though weve been together longer and he just met that someone else and its quite more like he was so confused those days. Then when we get to talk again we both realize that we are still in love with each other, which the other lady knew ever since.So he cancelled the petition and we decided to get married sooner which was supposed to happen before.

though some lawyers says it wont affect the petition since he cancelled it already

and some of those who have gone thru almost the same situation as i do says it wont affect especially we are married already. I have seen in the form I-130, that there is a question in there asking if he did petitioned someone else before or so..

Please we need advise.

Hello.. yes i i-130 there is a question about have you ever filed something like that.. but dont worry because just answered it "yes" then put the name of that other girl, put the place,date of filing and result..

It will not affect your application because you are married and make sure your husband cancelled that k1 application..

I've been k1 petition before and then we cancelled it and we got married..hope this will help you..

it will have no impact on the approval process

it may come up in your interview

uscis - completeness of paperwork and some background checks

nvc - visa application, aos and some more background checks

embassy - verification of a bona fide relationship

plan on approval taking up to a year, hopefully less with some of the shifts in facilities

get the marriage cert and roll! don't worry now, this darn thing is already a tough wait

Just make sure you both stay committed for the long haul. The CR-1 is averaging about a year now. A cancelled visa petition will have no bearing on your current case. It does send other conflicting signals, though. If I were an interviewer, it would make me wonder whether he is serious about the marriage or not, and so I would want to see more evidence in the I-864 that you will not become a public charge one in the US.

i actually prefer to stay with him here but i cant bear the fact that he will be too far as well with his family and that he will be so sad.. while i am almost alone here having my family gone as well, different places..

now i am enlightened.. you are right simeon, thinking like an interviewer too, i would wanna ask about this situation, i guess were both ready about that and his whole family, his parents even wants to come over or do something to help us get over that problem thats why they were here on the wedding, and asked if they could do anything to help to prove that ours is genuine and true love..
