Renewal of AOS I-485 and EAD I-765

Hello everyone,

Background:

My wife received her work authorization card through the I-765 documentation back on May 13th of this year and will expire in May, 2014.

My wife has just received her green card (Sept. 10, 2013) through the K1-fiance process and therefore has conditional status. This will need to be renewed as well (a long ways away).

Question:

1) Does the green card count as work authorization? Basically, I am wondering if I even need to renew her EAD (I-765) in may if she has a green card?

2) I am a bit confused on my green card renewal. Since there is conditional status on it I must do a Lift of conditions through the I-751. When must I do this? Is it after two years of marriage or is it when I renew the green card.

2B) If she is going to become a citizen do I even need to renew the green card (I-90)? Or do I just lift the conditions? Does the green card expiration date mean that I have to lift the condition or renew or both?

Sorry If I am confused, and yes I have read the guides multiple time so I am genuinely confused here and need a more thorough explanation.

Thank you for your time and patience.

-Ryan

1) Yes the green card counts as work authorisation so don't need to renew EAD.

2) you need to do removal of conditions when the 90 day window opens, you must do this or she will loose her LPR status. The window opens 90 days before the card expires by filling I751.

2B) You must file for removal of conditions she will then receive 10 year green card and can then apply for citizenship 3 years after granting of LPR status

Ahh okay,

So that means that the expiration date on her green card is the date that I must have her condition lifted? (well 90 days before that)

And I only need to use the I-751 correct? The I-90 is for people who have a 10 year green card that will expire and they have not become naturalized?

By the way what does LPR stand for?

I-751 is the proper way to renew a conditional card (and it will result in a 10-year card). I-90 is for people who already have the 10 year card.

LPR is legal permanent resident. A conditional resident has all the same rights and responsibilities as a non-conditional resident, and they are both LPRs. A conditional resident just renews the card in a different way.

AOS for my husband

ROC:
5/23/12: Sent out package
2/06/13: APPROVED!
