That post needs to be edited. We contacted the senator on Feb 4 and today, Feb 5, our website status is changed to RFE.

Yes, it is something but I think lucybelle had a bad experience with RFE so I am not raising my hopes. It means an additional delay till the RFE mail reaches us, the time taken to get what they want and then time till they receive our mail. All spells PRECIOUS TIME WASTED to me. I pray you get your approval soon and it better be an approval not an RFE. You have been waiting even longer than me, sheesh! Do contact your senator.

11/6/2013: Case was transferred to Nebraska Service Center.

1/6/2014: 60 days of transfer are up, put in an e-request, given 30 days' time. Contacted the senator. Senator asked to wait till Feb 6 and if nothing then she will do something.
2/5/2014: Website status changed to RFE.
2/10/2014: Attorney gets RFE. They need G325A and photos of both me and husband, original marriage certificate, copy of marriage record and it's translation.
2/15/2014: Mailed the requisite documents to husband.
2/19/2014: Documents received by husband.
2/24/2014: RFE mailed.
2/26/2014: Case status changed to RFE review.
3/6/2014: After 367 days, NOA2.

After approval kept calling NVC but NVC always had one reply, file was not in their system. Husband too called USCIS National Customer Service Center and was told case was sent to NVC.
4/2/2014: Write to NSCFollowup to know about the status of the petition.
4/10/2014: Put in a ?service request with USCIS starting with OVP to locate case.
4/16/2014: Reply from NSCFollowup that the U.S. law prohibited that office from responding to anyone other than the petitioner and to have the petitioner contact them.
4/18/2014: Sent email to NVC Research to locate the case.
4/22/2014: Petitioner sent email to NSCFollowup
5/14/2014: Receive email from NVC Research that they do not have a record of receiving the petition.

my senator made an inquiry for me on 2/3/2013. but hadn't heard anything from her yet. i also made service request on 1/31/2013 too..so far nothing..sad and depressed like the rest

Previously, GAFL told me:

"I did everything up under the sun plus more. I am not sure if any of it worked or if it was just our time to be approved.

All of this was probably started from about May 2013 up until January 2014

I contacted Congressman Ross 3 times.

I contacted Obudsman Office 2 times.

I went to 3 infopass appointments.

I sent an email to Texas Service Center & the Main Service Center.

I put in 2 service request via the 800 number.

I put in 2 e-request via online.

So as I stated earlier I do not know if any of this helped or if it was just our time."

Coming to myself, I had been telling my husband to contact the senator since a long time. Last month, he called the senator's office but it was snowing heavily in his city and the senator's office asked him to call on Feb 4. I wrote to the service center but one e-mail address generated an auto reply that e-mails not having the service request number may not get further response. The other e-mail address, I sent two mails but did not get any reply. With the transfer notice, the supplement was sent to call or create an e-request if no decision was made in 60 days of transfer. After the 60 days were up, I created an e-request under the "typographical error on a notice you received" since there was no appropriate category to put my e-request. I got an e-request confirmation number like SRXXXXXXXXXXXMSC on successfully creating the e-request and the following message was displayed, "You have successfully submitted an inquiry to USCIS. You can expect to receive a response within 30 days. If you do not receive a response within 30 days, please call USCIS Customer Service at..."

Yesterday, my 30 days were up and I was going to send an e-mail to the service center quoting the e-request confirmation number, but I couldn't send an e-mail because the net was down and then when the net resumed I found we received an RFE. Like GAFL, I do not know whether creating the e-request helped, or writing to the ombudsman and the service center or contacting the senator. Maybe it was just my time.

On February 5, 2014, we mailed a notice requesting additional evidence or information in this case I130 IMMIGRANT PETITION FOR RELATIVE, FIANCE(E), OR ORPHAN. Please follow the instructions on the notice to submit the requested information. This case will be in suspense until we receive the evidence or the opportunity to submit it expires. Once we receive the requested evidence or information and make a decision on the case, you will be notified by mail. If you move while this case is pending, please use our Change of Address online tool to update your case with your new address or call our customer service center at 1-800-375-5283.


A request for evidence is made when an application/petition is lacking required documentation/evidence (initial evidence) or the officer needs more documentation/evidence (additional evidence) to determine an applicant's eligibility for the benefit sought. We may send you a request for evidence at any stage of our review. The request will indicate what evidence or information is needed for us to fully evaluate your application or petition. Also can anybody tell me what RFEs the Nebraska Service Center usually issues. Some months back, people were getting RFEs for marriage certificates in their native language, I think it was the TSC.

Rightnow your main task is to send whatever USCIS wants and get an approval. However, when everything is done, and you get here I would really want you to go see your lawyer and confront him. the main reason your husband hired a lawyer is to makesure that everything goes smoothly, so how come there is an REF? Clearly he did not do his job. I am not aware of your background, but when my case was deayed my relatives sucked the soul of of me by constantly questioning me.

If you can convince you husband, I would suggest that once you get approval letter, remove the lawyer and do all the paperwork by yourself. VJ family will guide you at every step. And finally, DO NOT PAY THE LAWYER, I REPEAT DO NOT PAY HIM, NOT EVEN A DIME.

I am not aware of your background, but when my case was deayed my relatives sucked the soul of of me by constantly questioning me.

I am with you on this. Its very difficult to explain to them that there is absolutely nothing we can do about USCIS delays. They just assume its lack of effort on my part.

At about the 6th month mark my grandfather started doing this to me. He probably wishes he hadn't at this point. :P He finds it unfathomable that putting in a large amount of effort and contacting everyone possible may still result in nothing.

Got our case # today we have to pay our AOS we don't have an attorney, we are trying to save money, my husband thinks we should get one....... Who's doing this on there own????

I am. I wouldn't bother getting an attorney at this point unless you have a super complicated case. If you have questions about the forms or paperwork, you can always ask here. People here usually try to give the best advice possible and don't even charge you for it. :)

Rightnow your main task is to send whatever USCIS wants and get an approval. However, when everything is done, and you get here I would really want you to go see your lawyer and confront him. the main reason your husband hired a lawyer is to makesure that everything goes smoothly, so how come there is an REF? Clearly he did not do his job. I am not aware of your background, but when my case was deayed my relatives sucked the soul of of me by constantly questioning me.

If you can convince you husband, I would suggest that once you get approval letter, remove the lawyer and do all the paperwork by yourself. VJ family will guide you at every step. And finally, DO NOT PAY THE LAWYER, I REPEAT DO NOT PAY HIM, NOT EVEN A DIME.

Your post both made me laugh and on a serious note echoed what I had been feeling, how come we got an RFE despite having a lawyer whose job was to ascertain everything was in order? But still I gave our lawyer benefit of doubt as the RFEs most people get are senseless; they simply want an updated biographical form, extra photos, "original" marriage certificate in your native language when in fact the original is in English, proof of registration of a marriage when it is already mentioned on the marriage certificate, or sometimes they simply lose your stuff and ask you to send in another copy. About the lawyer's fee, he already had a sizeable portion of it before he even handled the case.

1/16/2013: Got married in India.

I-130:
2/28/2013: Attorney mailed the I-130 from a U.S. address.
3/4/2013: Priority date, NOA1.
11/6/2013: Case was transferred to Nebraska Service Center.

1/6/2014: 60 days of transfer are up, put in an e-request, given 30 days' time. Contacted the senator. Senator asked to wait till Feb 6 and if nothing then she will do something.
2/5/2014: Website status changed to RFE.
2/10/2014: Attorney gets RFE. They need G325A and photos of both me and husband, original marriage certificate, copy of marriage record and it's translation.
2/15/2014: Mailed the requisite documents to husband.
2/19/2014: Documents received by husband.
2/24/2014: RFE mailed.
2/26/2014: Case status changed to RFE review.
3/6/2014: After 367 days, NOA2.

After approval kept calling NVC but NVC always had one reply, file was not in their system. Husband too called USCIS National Customer Service Center and was told case was sent to NVC.
4/2/2014: Write to NSCFollowup to know about the status of the petition.
4/10/2014: Put in a ?service request with USCIS starting with OVP to locate case.
4/16/2014: Reply from NSCFollowup that the U.S. law prohibited that office from responding to anyone other than the petitioner and to have the petitioner contact them.
4/18/2014: Sent email to NVC Research to locate the case.
4/22/2014: Petitioner sent email to NSCFollowup
5/14/2014: Receive email from NVC Research that they do not have a record of receiving the petition.
5/16/2014: Congressman's immigration caseworker contacted supervisor at NSC who said the petition is pending and will be dispatched in two weeks.
5/27/2014: Petitioner received response from NSCFollowup that the case was pending an internal extended review. Really?
6/19/2014: USCIS case status change, "On June 19, 2014, we shipped this case..."
7/1/2014: Case received at NVC.
7/14/2014: NVC case number assigned.
8/1/2014: AOS and IV fees invoiced.
8/2/2014: AOS and IV fees paid.
8/5/2014: AOS and IV fees status changed to paid.
8/6/2014: AOS and IV packages mailed, completed and submitted DS-260.
8/7/2014: AOS and IV packages delivered to NVC.
8/8/2014: AOS and IV packages put into the system (scanned).
9/20/2014: Get the 60-day email.

Your RFE might only be because they want to buy time with your case. You posted above all the contact you have had regarding the status of your case. I totally agree with you; they have been known to ask for things not required.
