I-130 MARCH 2013 FILERS!! NBC

I don't know why I even bother calling USCIS anymore. I just got off the phone with them. Before I talked to a live person, the automated case status system told me the date I was transferred and that I should have an update within 180 days! When I asked the rep why the discrepancy from the 60 days stated in the transfer notice, she gave me the usual canned response that they're experiencing delays and they're currently processing Feb 12... I also told her I'm going to visit my wife next week for 3-4 months (hopefully she'll have a visa by then so we can make the trip back together) and to be present for our first baby's birth, so I wanted to make sure they emailed me with any case updates. She proceeded to tell me they don't email those (!) and that I will receive notice via snail mail instead. Useless...

I really do hope that you can come back together and enjoy the birth of your baby.. This really breaks my heart, how do they not acknowledge the pain that all of us are going through, there really needs to be some type of movement made and cases that are filed in June or July should not be approved before us that is just plain ridiculous and damn unfair!!!!!

12/30/2012: Got engaged.
1/16/2013: Got married in India.

I-130:
2/28/2013: Attorney mailed the I-130 from a U.S. address.
3/4/2013: Priority date, NOA1.
11/6/2013: Case was transferred to Nebraska Service Center.

1/6/2014: 60 days of transfer are up, put in an e-request, given 30 days' time. Contacted the senator. Senator asked to wait till Feb 6 and if nothing then she will do something.
2/5/2014: Website status changed to RFE.
2/10/2014: Attorney gets RFE. They need G325A and photos of both me and husband, original marriage certificate, copy of marriage record and it's translation.
2/15/2014: Mailed the requisite documents to husband.
2/19/2014: Documents received by husband.
2/24/2014: RFE mailed.
2/26/2014: Case status changed to RFE review.
3/6/2014: After 367 days, NOA2.

After approval kept calling NVC but NVC always had one reply, file was not in their system. Husband too called USCIS National Customer Service Center and was told case was sent to NVC.
4/2/2014: Write to NSCFollowup to know about the status of the petition.
4/10/2014: Put in a ?service request with USCIS starting with OVP to locate case.
4/16/2014: Reply from NSCFollowup that the U.S. law prohibited that office from responding to anyone other than the petitioner and to have the petitioner contact them.
4/18/2014: Sent email to NVC Research to locate the case.
4/22/2014: Petitioner sent email to NSCFollowup
5/14/2014: Receive email from NVC Research that they do not have a record of receiving the petition.
5/16/2014: Congressman's immigration caseworker contacted supervisor at NSC who said the petition is pending and will be dispatched in two weeks.

Congratulations on all approvals!

Unfortunately our process remains unbelievably frustrating. After receiving an email on Nov. 25th that an RFE has been sent out, we found out yesterday (hard copy arrived) what they 'want' from us.

The letter stated that my husband (USC) doesn't seem to be eligible to file an I-130, since he has not provided enough proof that he actually is a US citizen. It seems that the complete copy of his passport he sent in (according to the instructions) is not satisfactory to them.

On top they said we didn't send any photos of either him or myself.

No words.

Phone calls to the USCIS didn't help. They even refused to transfer my husband to a Tier 2 officer. I guess we will have to send in 'the basics' that we provided to start with (9 months ago) again.

Sorry for venting. Has anybody experienced anything similar?

Was he born in US? If not he should also send in proof of naturalization along with passport copy.

No. As far as I remember the instructions said OR (birth certificate, copy of passport, proof of naturalization...). I guess they must have lost the copies and also the passport photos that we sent in. But on the phone they wouldn't go there. Just kept repeating what was stated in the letter.

People on phone has no clue other than what they read online. I would make sure he sends his birth certificate along with passport copy just incase. I hope you get good news soon!
