WHEN AM I ELIGIBLE TO FILE N400

You did not arrive on a K1, you obviously don't know much about them. That's fine. My CR-1 knowledge is extremely limited as well.

You do not have to file AOS asap. You do accrue out of status days once the I-94 expires, but as previous stated, this is not a bar to AOS.

The OP was very clear about her "resident since" date. I'm honestly surprised this went past page 1.

If you didn't apply immediately and risked losing your status, it's your issue. It doesn't make logistic sense as you can see per VJ link. Obviously anyone can do that. As OP didn't really explain her situation, I thought it was worth to point it out. I stand by my post and I will be glad if it helps OP or anyone else.

OP seemed confused to me. My intuition says she doesn't understand the resident date is the one that matters. My intuition rarely fails me and even if it did this time, so what? Did I tell her to do something wrong? Telling her to make sure will do any harm? LOL.

It went past page 1 because some people like to create issues where there's none.

Hmm so the term first is superfluous. Okay. How is that relevant here? Does it matter? I wanted to make sure OP understood I did NOT mean the 10 year GC. Cappice? It was relevant to me to emphasize that. Any problem?

I READ and UNDERSTOOD OPs post as I said before.

BUT I wanted to convey to her that the date that really matters is when she got her resident status. I really don't understand whats the big deal with me wanting her to make sure as she doesnt seem knowledgeable about the process. Cant you guys get it? Weird.

Again, the OP's FIRST GC could have been a 10 year GC. You don't know, AND it's irrelevant because THE DATE IS THE SAME ACROSS CARDS. I don't understand how you're not understanding this concept.

Your initial post, while correct when you said "check your date", was WRONG when you said "check the original GC". Not only could the OP be talking about their "original" GC when they mention the 10 year (depending on how they filed), the "resident since" date does not change across cards.

Further, your comment about how it must be wrong seeing she arrived in 2008 was also... misguided. A few of your other comments, as well as your quite rude replies to a knowledgeable member of the forum who pointed out your errors, has resulted in this lengthy discussion of an extremely easy answer (which was in post #2).

You do not like being told where you were wrong. Your information while most likely well-intentioned, was incorrect on a few things to the point where it could have confused the OP.

You obviously never understood the OP or this lengthy back and forth wouldn't have occurred, because the OP CLEARLY stated their resident since date. You just decided you knew better.

It doesn't make any sense to you but it happens ALL the time. Don't go assuming you know anything about the situation of anyone else.

You didn't know that information before you went trolling for info to back you up. It still doesn't back you up because it's not the main point. The main point here is THE DATE DOES NOT CHANGE!! It doesn't matter whether she has 50 GC's in her life. The "resident since" date will ALWAYS be the same.

Great. If she doesn't have an original GC, so we're all good right? What's the problem here exactly? AGAIN - I don't see what's wrong with telling her to double check.

BTW, me and you already had issues when I had an older profile, so we clearly don't have the same mind frame. I don't think we should keep discussing to be honest, and I've reached that conclusion a few years back.

I obviously follow my intuition (which is a foreign concept to certain personality types) and told me OP is confused. The back and forth occured as I stand by what I said. You stand by what you say as well? Feel free to keep posting. I don't decide I know better. I gave my opinion which is as valid as yours. I know you're implying you and the other poster have been here longer than me, (and therefore feel more entitled) But this is actually not true - this is just a newer profile, I've been here longer than both of you smile.png

OP has her information but just in case it got lost.....You can file 5 years minus 90 days from the date of resident since shown on your green card. You can't file in the three year period anymore because you are divorced.

I got my conditional green card January 2010. Wasn't able to file right away for AOS cos my ex husband got laid off back then. So yeah, I got my date right. Thanks :)
