anyways I have called to USCIS last tuesday and they told me they are still on the March applications.

The operator says that but if you look online, that March date hasnt been updated since like November I think..they should be updating it soon and it will most likely say June/july apps ... also, vj august members have been getting transferred and approved..so we should be next! :)

Hi everyone,

A few weeks back I told you all about how my husband had written to his Senator's, copying the New York Times. Well, after both of us being interviewed Julia Preston, the NYT Immigration Journalist has written a fantastic article highlighting our - and yours - plight. It is to appear in Sunday's NYT, 9th February. It is also online. Pass this to all your friends and family and hopefully all our NOA2's won't be too long.

It's a GREAT article! Kudos to you guys for being willing to be featured! I also think it makes a lot of great points about how unfairly spousal visas are being handled by being put behind the line for these visas to help people who did things illegally. I don't mind them getting a break, but, they should have to wait in line while the legal eagles are getting first crack at priority processing! (Sorry if that sounds mean, but it's just simple logic to me.) Either way, good luck with your visas getting processed quickly!

Quick update... our interview is finally scheduled for Thursday, 2/13. He had his medical last week. Don't know if I updated you that they rudely rescheduled his interview by mail...no call, not a personal note, just a printout, underlined "RESCHEDULED" in red--no question about if there's a preferred date. Totally impersonal. It really upset me. So, we have the date before Valentine's Day...so, we're hoping all goes well. On a positive note, his medical was a really positive experience. I know we've read that some people have awful experiences...and it may depend on where you're at...but, his experience was fabulous. Nice doctor. Very polite. Conducted the exam, blood work, and x-rays, with a very personable, friendly disposition. Can't ask for more than that...except perhaps that it didn't cost so much! girlwerewolf2xn.gif (Like everything in this process, eh?)

How strange. Would this be this first you've visited since sending the petition? My hubby has already come over twice on VWP since filing and was honest when they asked if he intended to move here eventually since he said he was visiting his wife, and he said yes, that we filed the I-130 and are waiting for its approval, and they just nodded and stamped his passport. As long as you have a record of leaving when you're supposed to, and sufficient evidence of strong ties back to your country, I don't see why they would deny your entry. Only answer the questions they ask and provide evidence if required. Don't give them more information than they ask for.

Is Canada under the VWP?

If this is true, that is amazing and truly an answer to a huge problem. My husband is in England and we want to see each other before our I-130 is processed. He hasn't been state-side in almost a year and hasn't seen my family since we were married last May. However, I don't think it would work for us as he lives with his parents at the moment-- the only thing really tying him to the UK is his job... not sure if a letter from his employer would be substantial enough evidence to admit him.. I wonder if it is even worth trying :(

So how long will the total time for you have been from NOA2 to interview? Just curious.

I honestly don't think we'll start seeing any NOA2s for September until May or June. I'm such a pessimist....I know.

My hubs lives with his sister and doesn't have a mortgage or lease so I wouldn't worry about that. Just be honest when they ask questions. They've never asked for supporting evidence but he always has it on him (basically letter from his manager stating the date he would return to work on a letter with the company letterhead and the manager's contact information and signature). If he has a good track record of leaving when he's supposed to, then I see no problem in him visiting! Good luck!

My hubs lives with his sister and doesn't have a mortgage or lease so I wouldn't worry about that. Just be honest when they ask questions. They've never asked for supporting evidence but he always has it on him (basically letter from his manager stating the date he would return to work on a letter with the company letterhead and the manager's contact information and signature). If he has a good track record of leaving when he's supposed to, then I see no problem in him visiting! Good luck!

Our attorney advised us for my UK hubs not to travel here while processing--- but she has advised us also to get the K3 which others have said is pretty much obsolete so not sure she is up to snuff on things. Our attorney advised us for my UK hubs not to travel here while processing--- but she has advised us also to get the K3 which others have said is pretty much obsolete so not sure she is up to snuff on things. Just wondering if you had heard other successful stories of entering the US while an I-139 and K3 are being processed. Thanks!

I'm not sure about the K3 but I think it's the same thing. He should be fine to visit, especially with the VWP. My hubs will be visiting for the 3rd time since filing next month and although I still get a moment of panic when he doesn't come out quickly due to the huge customs line, he always comes through the doors. :)

He also visited while our I-129F was processing last year and did not have any problems coming through.

I'm not sure about the K3 but I think it's the same thing. He should be fine to visit, especially with the VWP. Yeah. If anything, we SHOULD at least be transferred and if we're lucky, approval 6-12 days after that from what I've been seeing from July and August. :)
