Co-Mingling

Hi everyone, I am still stuck in the AOS phase, but since I would like to be prepared for the next step (i.e., ROC), I thought I'd put my questions here.

I am the beneficiary. We are planning on starting to build our own house next year. Until then, we will still be living with my husband's parents. I have read a lot about having to prove co-mingling for the whole period from marriage until the ROC window opens (joint utility bills, lease agreements, etc). Now, where will we be standing when we don't have any joint utility bills or lease agreements since his parents pay all of that until we have our own house? Has anyone ever been successful in providing an affidavit from the parents (confirming we are living with them) for their ROC?

Second, we have joint savings and checking accounts. For some reason, my name does not show on the bank statements of our checking account though. Will that come to bite me for ROC (I assume yes)?

I'd like to get that stuff straightened out now that it is still pretty early, hence I am asking. I am not that familiar with ROC yet, so if those questions have been discussed before, I apologize. Thanks for any input!

Get a letter from your in-laws that you stayed for the period you stay with them and that will do. Take up with Bank and get your name be shown up in the statements - this is critical for you.

Have you prepared Wills, Medical Powers of Attorney, etc.? These are stronger and more "mutual" than just about any other document.

Thank you all for your input! We will go to our bank ASAP to get the name problem fixed. We do not have any wills or medical powers of attorney yet, but will get this done as soon as we can. I will show my husband this thread as well, so he knows this is *absolutely* critical for our ROC.

OK, I have a follow-up question. We got all the bank-account stuff sorted out, so my name now appears on all bank statements. I am wondering now though, we got married in February 2013, but we did not get my name added to my husband's bank account until early April 2013 (as we had other priorities at that time, like filling for AOS, Driver's Ed for me, etc.). Will those two months affect my ROC, or will they be "forgiven" if we have seamless monthly bank statements afterwards?

Yes that should be fine. Just mention in your cover letter that you could get the joint accounts done in April 2013.
