depressing k1 Interview

Hello everyone!

My Fiance went to the interview on march 2nd. Even before the Consulate started interviewing him, he got a blue sheet in his hand and then he started questioning him.

Consulate: From the pics it doesn't look like its an Engagement. It is a big hall. This should be a wedding.

Fiance: No its an engagement.

Consulate: How many people were there? You swear that this is an engagement?

Fiance: Yes i swear.

consulate: Ok, I have to put you on enquiry. Go pay the DD

He gave my Fiance the blue sheet and one of the officials told him that he should give the fingerprints, all the papers are ok. "You don't have to come back to the Consulate, if everything is fine we will call you, you send us the passport we will send you the visa. We will send the fingerprints to FBI. It will take about 4 to 6 weeks."

I'm very upset right now :( Please advise. What shall I do? Should i wait or consult a lawyer?

awww sweetie I am sorry that happened, I know sometimes they think there doing their job, and they are. But they forget they are dealing with"real" people. I wold suggest just hang in there for the time being, try not to panic and think positive !!!!! They just do things the weird way and try to come off as intimidating (they can be) I will pray for you and your fiancee. Be patient :) it will all work out

Even before I was done reading through your whole post, it sounded like India to me. He probably got the blue sheet because there was a name hit and the consular knew right at the beginning of the interview that your fiance was going to have to submit fingerprints. My husband (new delhi) also gave fingerprints (although he was told it would take 15-20 days, HA!). It has been almost six weeks and we are hoping to hear something soon.

I know it is depressing (trust me! I was so mentally prepared for him to be here with my by now), but unfortunately you are just going to have to wait it out. Calilng the Embassy or NVC won't help (I have tried!). The good news is that all your paperwork is in order and he will most lieky get the visa once the prints clear. The bad news is the wait....

Does your fiance have a common Indian name?

1/6/07 - leaving for USA

1/20/07 - Wedding Date

1/20/07 - MARRIED!!!!!

2/10/07 - rec'd certified copy of marriage license

3/13/07 - AOS package rec'd at Chicago Lockbox

3/20/07 - Rec'd Social Security Card

3/21/07 - Checks Cashed and Case Status online

3/24/07 - NOA1 Rec'd for AOS and EAD

3/27/07 - rec'd Biometrics appt letter - scheduled for 4/20/07 @ 11:00am

4/02/07 - "touched"

4/20/07 - had biometrics appt.

4/21/07 - rec'd letter stating case was transferred to CSC

5/22/07 - rec'd Case Pending at CSC email

6/25/07 - EAD card production ordered

7/7/07 - EAD "touched"

7/7/07 - AOS "touched"

8-6-07 - Rec'd EAD Card in the Mail

5-20-08 - AOS INTERVIEW - APPROVED - PASSPORT STAMPED

Sorry to hear about your being on AP or AR. I can tell you that you cannot do anything until they finish their investiagation. My husband also got AP and we are still being processed. Just take and pray for patience and hopefully it will not take long for your case to be finished. Once the embassy starts AR/AP a lawyer, senator or congressman cannot help you. I also have to ask did they just do the two index prints or all 10 fingers for his FBI check? If they did 10 means his name had a hit in a data base already. Good luck.

Yes! Everything was in order. But people do engagements in halls like grand function. I don't know why he said so. And also he asked. Why are you stand so close in the pictures? my fiance said, "why can't we stand taht close if we are engaged?

Yes! it is India, Chennai. My fiance name is Omar. Well! now he is upset. He is asking me to come back to india, so that we will get married over there and reapply for spouse. He does not want to wait. Actually he works in Dubai. Now he can't even go back to his work 'cuz they said it will take 4 to 6 weeks. I am really confused.

Why can't he go back to work? Did they take his passport?

If you go back and get married, you will have to start the process all over again, as a K-3 visa. The wait will be even longer. Just tough it out for another 6 weeks and get the K-1. The officers did not deny his visa, he just had a name hit and needs a security check. This would have happened even if you were married and were going for the K-3 or CR1 visa. Wait and see what happens first.
