There was a news story in the UK recently about a man who was caught with a prostitute in his car and his story to the police was she was helping him look for tomatoes. To me your fiance's story appears to be just as ludicrous! I'm sorry this happened to you but as the others have said what else has he not told you?

In light of new obstacles you've revealed, I would recommend you to get married first. Then file a CR-1 petition for him (I'll leave the detective work about him and his past relationship to you. I'll just assume you decide to continue your relationship with him).

I said so because I put myself in the shoes of the CO in Saigon and I just couldn't see how I would give your petition as of right now as a K-1 a pink slip. Overthere, when there's doubt, they'll play it safe, place it in AR.

Remove that doubt now. Get married in VN. It doesn't neccessarily guarantee a success but at least affirm them that you two already are willing to be committed to each other.

a K-1 is only a promise to get married and you know how "promises" are treated at the US Consulate in Saigon. Almost non-reliable.

What's AR? I know what AP is but never heard of AR :(

Maybe. My understanding is if the decision is just being reviewed, that in different that waiting for further processing under 221g. AR may lead to AP, or vice versa. Edited by The Patriot

To answer your question, I don't know of an immigration answer but I think you're putting the carriage before the horse. I think you should reset and get to know your future Spouse more before forging ahead.

He spoke with a lawyer and apparently this is a common mistake among k1 visa applicants. Possibly because marriages were scarcely documented? Per the lawyer, fill out the DS 230 form and submit as usual to Get inteview date. have a letter explaining the mistake on the i129f form and present our case. I'm aware my fiancé had previous relationships and of course I can't cant change the past. It just aggregating cause this is potential something that can hold the process even longer. Generation gap has different ways of thinking I guess.

And I know that people are forgetful but this is immigration involved. We say we forgot this. But they can look at it that we are hiding it from them.

My fiancé view is if we were to hide it we wouldn't try to correct it now. I'm just thinking if he was smart he would have told me. -_-

I dont think anyboby would ever forget their marriage except some health problem involved. It might be the case that he hid that from you at beginning. When you were filed I-129F, he did not want you to know about it. At this stage, he might think the process is about to finish and you will forgive him no matter what.

I dont think this is a common mistake for K-1, I can believe someone was accidently clicked single instead of marry. It is true that if you hid then why you guys try to correct it now. But CO might think you guys were lied to get approved from USCIS ( half way of paperwork) , and tried to correct it now.

I have a question for you: Do you include his daughter in I-129F? or the daughter lives with her mom?

My fiancee came to US on the 8th of March, 2014 under K-1 visa at Newark, NJ Airport for POE.

Applied Social Security Number on the 10 of March, 2014.

Married on the 13th of March, 2014.

Sent I-485, I-765, and I-131 on the 15th of March, 2014.

Received EAD on June 7, 2014.

Received Notice of Potential Interview Waiver on July 1, 2014 date 6/27

Contacted Ombudsman on 01/12/2015.

Ombudsman contacted USCIS on 02/20/2015.

Ombudsman sent a follow up to USCIS on 03/18/2015.

I-485 approved on 03/31/2015 ( we ordered your card).

Welcome notice was mailed on 04/01/2015.

Received Welcome Notice on 04/08/2015.

Card was mailed to me/picked up by USPS on 04/08/2015.

Received GC on 4/10/2015.

I'm really happy that you found love and all..... but if his story of forgetting his previous marriage got all the eyebrows here raised, I'm pretty sure the consul won't have any of it. Because of his "forgetfulness", they might think the whole application is a fraud.

Are you ABSOLUTELY SURE you want to marry this guy? A life of trying to find out if he is keeping more from you sounds like hell. "You never asked" ... wow ... I'm really bothered for you sweetie

I have been on this site since 2004.

This is the first I forgot I was married I have seen.

Maybe he did forget the marriage since there wasn't a celebration... but I refuse to believe he would forget about the divorce process. from what I heard, its almost always messy

I wonder, is there something being lost in translation here? I don't think forgetting you were married is a common problem. Maybe forgetting to mark it down but...

Something smells very fishy here...I hate to say.
