Exactly 8 Months since filing, no RFE or NOA2. Think I messed Up?

Hi Folks,

When I had initially filed the petition, I didn't really know what I was doing. I knew I needed the i129 F and so started my learning at USCIS. The website didn't say anything substantial about the need for additional forms and other proof (per se)... I got the impression I just filed the petition, prepare my documents and proof and then they will ask for that stuff later.

Because at the time, my fiance and I were looking to come together roughly 9-10 months out from the file date, we figured even with the RFE that it couldn't be too bad since the average wait at the time was 5-6 months. Now we're a month away from the original time we thought she'd get here and we're feeling quiet discouraged. She is having to look for housing and ways to support herself and I haven't seen her in 9 months.

I had asked this question before and someone said if I only sent in the i129F that I would be just flat out denied. Can anyone confirm or deny this assertion? We are really worried about being denied and going through more waiting and roadblocks.

The stupidest part is that we've since prepared all the required info but USCIS agents simply tell me to wait for the RFE bc whatever I send them now will probably never make it to my case.

Would really appreciate any insight.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

or maybe if you're lucky you'll get an rfe...

but thats weird they're making you wait so long and my date was jan 07 and i already have everything ready for my interview on september 10 t-t

[August 16th 2013] CEAC updates - London logs my medical results

[August 23rd 2013] I call DoS and they tell me my interview date, (2 weeks since I sent ds-2001)

[August 27th 2013 CEAC update - London dispatches packet 4]

[August 29th 2013] Packet 4 received
[september 24th 2013] Interview -
Refused due to passport and birth certificate condition

[september 26th 2013] Emergency appt at HM Passport Office London - New Passport and Birth Certificate in hand
[september 30th 2013] DX collects passport and birth certificate

[October 3rd] - Docs delivered to Embassy

[October 10th] - London Approves and Issues our Visa!!

[October 16th 2013] 4.00pm - Visa in my hand, 11pm POE -Newark

If you does not send what are requirements, then you will get RFE not denied. You have to wait for RFE if you might have. RFE has cover sheet and will indicate that is for your case. If you send whatever info to USCIS now, it would not go to your file.

It seems he sent I-129F without G325A and no poof.

New Journey AOS:

My fiancee came to US on the 8th of March, 2014 under K-1 visa at Newark, NJ Airport for POE.

Applied Social Security Number on the 10 of March, 2014.

Married on the 13th of March, 2014.

Sent I-485, I-765, and I-131 on the 15th of March, 2014.

Received EAD on June 7, 2014.

Received Notice of Potential Interview Waiver on July 1, 2014 date 6/27

Contacted Ombudsman on 01/12/2015.

Ombudsman contacted USCIS on 02/20/2015.

Ombudsman sent a follow up to USCIS on 03/18/2015.

I-485 approved on 03/31/2015 ( we ordered your card).

Welcome notice was mailed on 04/01/2015.

Received Welcome Notice on 04/08/2015.

Card was mailed to me/picked up by USPS on 04/08/2015.

Received GC on 4/10/2015.

Any ideas folks? Any insight would be greatly appreciated.

All you can do is hope and pray for a an adjudicator that will send you an RFE and you send what was required according to the instructions on the website you said you looked at.

I have read many times here people doing what you did or even slightly more but forgetting key required documents and got denied. Money taken, start all over.

the sad thing is all this time you have been waiting. I would think your case is just sitting there hasn't even been looked at. Why not involve your congressman and or Senator. When asking them to inquire make sure you tell them what you did (the omission of required documents) maybe they can get things kick started for you.

Right, I'm definitely kicking myself. I just looked at the USCIS site where the i129F form was located. I thought proof was required at later stages and at the interview. I thought sending all the proof was just a way for people to be proactive and since we were afraid it would be processed TOO fast, we thought it would be ok.

I did not send the G325A. I literally called USCIS the month after and asked if I can send supplements and they told me to wait for a RFE. So I waited. I'm never going to forgive myself.

I also thought bc our case was transfered to another service center it was a sign that we may be one of the lucky ones but now I just think it only served to delay the denial.

Don't beat yourself up too bad. I swear if you did an advance search here on VJ you would find many a peoples who were lead astray.

Someone was just denied cuz the customer rep told them the wrong address to send their RFE so they got denied they complained fount it and their petition reinstated.

Now you know the USCIS is the "misinformation line". Stick with VJ the rest of your journey and you should be just fine.

I am sure they will just issue you an RFE and you can just send in all you need to. So just hang on. But do keep call.

But i would contact my congressman and senator though 7 months is a bit long ya know. Now breathe and smile. It is well.

Bc one it's after the fact and two USCIS reps tell us otherwise.

But you filled out the form and didn't bother to read and follow the form's instructions. I write this in the hopes that any a tiny bit proactive will know, even if you are not following the wisdom collected on VJ, if you are filling out a form, whether that form is for USCIS, DOS, IRS, SSA, VA, whatever, READ AND FOLLOW THE FORM'S INSTRUCTIONS. They are there for a reason. I129F instructions clearly indicate ALL the documentary evidence you need to include, and also points out that for K1 you need the G325A.... it was all there. Get in the habit now of following instructions that are printed with each and every form issued by the government. This should not have been "after the fact".

Having said all that. It is all spilt milk and you will just have to wait until the petition you entered is adjudicated one way or the other. You will just have to be patient now.
