Can K-3 visa be denied

Hi Folks,

My case is in US Embassy, Consular Section now. My wife already collected Packet 3 and she in process of doing medical exam and DS 156 (embassy require 2 copies). I sent the following docs to her via DHL and she already received them:

I-129F Package with approval (NoA2)

I-130 Package with approval (NoA2, both I-129F and I-130 approved in about 2 hrs different)

I-134 Affidavid of Support (Notorized)

Employment Verification Letter (Full time for six years in the same company and make 40k)

Letter from bank

On my wife's part, she has the following doc:

Marriage certificate

Birth Certificate

Police Report

Our few pictures from weeding

Can a Consular Officer still deny issuing K-3 visa? I was worried and paid $200.00 for I-824 to forward approved I-130 to NVC.

They can but only if you fail to fulfill the requirements of the visa (I realize this is a pretty broad statement) but it does not appear to happen frequently.

Why are you worried?

Coz, I applied for B2 visa for her after we're married. Consular Officer denied her visa. They even didn't allow me to go with her in interview. I was sitting outside like homeless. I felt so bad that our fellow American (Consular) was not helpful.

Denial of a B-2 visa while a "K" visa is in process is typical and should have been expected because now there is an "intent to immigrate" which is nearly impossible to overcome in the B-2 review. This will not be a factor in the "K" decision.

That is because she didnt qualify as a tourist when she has intentions of moving here and not returning.

I finally got rid of the never ending money drain. I called the plumber, and got the problem fixed. I wish her the best.

I would not worry about a visitor's visa being denied since some countries do not allow visitor visas but other visas are approved without any problems. I know a male coming from Pakistan cannot get a visitors visa to the USA I personally would not worry about the B2 denial and wishing you good luck on the remainder of your journey.

Namaste Ma and Timi,

Don't worry about the visitor's visa being denied. Just focus on helping her get her paperwork done accurately and neatly, etc... You may be surprised at how quickly they schedule her for an interview. My husbands was told, when he turned in packet 3 in person in KTM, to come back the next day for his interview! I'm not saying that will happen in your wife's case, but she should be ready in case it does.

In preparing for the interview, you want her to know what to expect, but you don't want to scare her. You may want to check VJ for other interview stories/possible questions. My husband's and stepson's interview was fairly straightforward and similar to what others have experienced at other consulates (other than the timing the day after packet 3 was returned).

do you have anything from before your wedding day to show that you've been in a relationship with your wife? Photos of holidays together, travel receipts, copies of your passport stamps, stuff like that.

divorced - April 2010 moved back to Ontario May 2010 and surrendered green card

Evidence of an ongoing relationship can take many forms but in essence it can be as simple as how do you stay in touch. E-mails, phone logs, IM logs, trips to visit, yada yada yada. Stuff that the CO can be shown that you have a true bonafide relationship.

My wife has a copy of my passport with visa stamps all over. Our marriage was an "Arranged Marriage". Of course we don't have any pictures before engagement. We exchanged email address after married. I call her every single day since I came back to State on Sep 15, 2006. I went to Nepal in Oct 2005 for 3 week, May 2006 for 3 weeks and July 2006 for 2 months (I was granted for 3 months leave from my work, but I came back to State because I couldn't do DCF). And took a lot of pictures in July and had a really great time in my life.

Ramro cha. You should have some good evidence with the photos and documentation of your trips. You may want to review a simple time-line of your relationship with your wife to be sure you both remember things the same way. It is common for consular officers to ask the applicant how many times the USC visited and/or when.

The pressure is on your wife to prove that your marriage is real. Give her as much proof as you can. In your case, phone bills would be good if you have them. You may also want to have her print out a few emails (you can cross out anything private in them). Make it easy for her to show your marriage is real, and make it easier for the consular officer to approve her for the visa.

Do you plan to be there with her for her interview?

I read your profile and it says you already booked a flight...

I hope I didn't give you the impression that everyone gets an interview the day after they turn in packet 3. In fact, after 2 years of reading here at VJ, my husband and son are the ONLY ones I know of who had an interview that quick. I hope it is quick for your wife, too, but I hope you didn't buy plane tickets for her yet. We waited until after we had the visas in hand to buy the plane tickets... I think it is much more normal for the interview to be scheduled weeks or even months after packet 3 is turned in to the Consulate. It's hard to determine if there's a pattern with KTM because there are so few people here at VJ going through that post.

And the picture on your profile is beautiful. Is it Machapuchare as seen from Pokhara? I hope we get to visit Pokhara next time we are there...

Thank you! Yeah! that's Machapuchare. Although I missed the summer here this year, I really had good time with my wife in Pokhara where she is from.

As you can see, I've done my part and now the ball is in her court.

When I call next time which is most probably tomorrow, I'll make sure that she will prepare as you've mentioned.
