Timeline

So we filed my husbands i-601 and i-212 on May 21st. But i did a little research and found out that he can come home based on medical emergencies... Well i will be 8 months pregnant next tuesday and have a c-section scheduled for October 8. Does anyone know how to send papers to NSC and actually have them looked at without someone throwing it on their desk? Any advice would be great. thank you

Normal childbirth does not constitute something you can use for an expedite, unless the life of the mother and / or child is at risk.

I dont think you read what i wrote. Its a c-section (major surgery!!!) not normal delivery where i am going to push a baby out. Im having it done for medical reasons such as diabetes.

A C-section is routine surgery, not a life or death thing.

Good luck on your c section...I know it's a major surgery my sister has had 5 of those! The uscis doesn't take the csection as a major medical issue...unless like mentioned above...

On the other hand, you can request for an expedite but an expedite still has a 1-3 month timeframe to be reviewed and approved/denied. If you are going to run with the csection issue I say get the ball rolling now.

It's not routine surgery. Its not like im having plastic surgery. Im sorry you think so. If you have never had it done or have never been told this was your only way of having your baby then you certainly will not understand the fear of it.

I did speak to an immigration officer and was told to get everything together and send the papers in quickly. She gave me the address and person i should send my request to.

It's unlikely you'll have an expedite request granted for that, but there's nothing stopping you from trying.

put it this way, ( as I was told by my attorney) the USCIS did not ask you to have a child before your husband gets here. I wish I had the email so I could copy and paste the reply I received.

I had 3 c-sections. Yea, its major surgery BUT routine. And it takes 30-60 days for them to even approve or deny an expedite. You can try but.........don't expect them to stop everything and process the expedite. I don't mean to sound like a jerk... I totally understand your situation ... I was just told they don't care

Also, the information given above is not incorrect. It is routine. Having a child is not a reason for expedite.

The advocate I spoke to at Senator Casey's office told me that expedites are few and far between. She has only seen 1 in 100 get approved and it isn't an easy task.

Good Luck. Maybe a sympathetic mom will be the one reviewing your request.

No, C-secs r considered regular childbirth even

when one is diabetic in uscis book, now if

a life and death situation arises they will look

into an expedite & that takes

FYI, most times they do c-sections is because it is life and death .. otherwise they wouldn't do them. I've had 3 of them and my first one was an emergency life or death..... so stop name calling .... Call me what you want.... Child birth is not a reason to expedite and several have posted the same information. The USCIS does not hand out expedites because someone is scared ... Blah blah blah its seems to me you think you are the only woman to ever give birth by c-section.

Don't assume I didn't try hard enough. YOU have no clue. I have to laugh... you come here to whine and ask about an expedite because you are having a baby. Talk to all the other posters who had to have their babies without their husbands. Of course it would be nice to be together but Like my lawyer told me, the USCIS didn't ask you to have a baby before your husband has his visa... Please stop the drama..

My reason for expedite was because my youngest daughter was diagnosed with a brain tumor and had to have surgery..and btw, her tumor could not be removed. Now, if that wasn't a reason to expedite, then I am assuming a c-section wouldn't be either. You just don't like hearing the answers to your posts..... I am sure my post will be removed but let it be known, YOU started the name calling

You should be a bit kinder to people trying to prepare you for the lack of concern about your feelings that you encounter with USCIS. They ( immigration) do not care that you will be separated for the birth of you child. There are so many C sections in the US it doesn't rank as an emergency unless there are underlying conditions. It is not that we don't care, it is that we have seen how people are kept separate by this process.

This will not be over quickly. You will not enjoy this.
