I really your stressing yourself out for no reason. People get to america with worse crimes. A traffic cone is does not come under that categories. If you have to sign a waiver so be it. Really stop stressing yourself you will end up in hospital then what good would you be to your fiance. Take it one step at a time. Get the waiver ready incase you need it. I doubt ou will but prepare yourself. Stress is toxic disease you know.

good call

but how do we prepare the waiver ????

and can we do so before the interview to take it

how much and all that ect ???

Since you asked:

http://www.uscis.gov/portal/site/uscis/menuitem.5af9bb95919f35e66f614176543f6d1a/?vgnextoid=bb515f56ff55d010VgnVCM10000048f3d6a1RCRD&vgnextchannel=db029c7755cb9010VgnVCM10000045f3d6a1RCRD

The I-601 is not DIY recommended. You need to enlist the help of a lawyer with a solid track record of approvals. They know how to word your plea in just the precise way. No guarantee it will work, but at least you can say you've tried everything.

However:

I've been following your threads and, to me, your defeatist attitude is not helping your situation at all. Only compounding stress and depression. Almost like you're searching for certainty that you will fail. That's not the right mindset to be in. It's toxic. I get that you want to expect the worst so you don't have your heart broken down the line, but your heart is breaking now anyway because you're torturing yourself. You don't know what will happen at the interview. All you can do is tell the truth when asked and present your case in the most genuine way possible. For every roadblock in life, there is a path around it. If it is meant to be, with love and creativity you will find a way to be together.

"If you’re brave enough to say goodbye, life will reward you with a new hello."

thanks for all the words to try and help boost me

but one thing you are all pretty much with all your partners who you love

and not having the worry of facing this massive task for happiness

i do try but after a terrible stressful last 2 years and loosing a best friend infront of your own eyes then loosing the woman who helped raise me as a child

then meeting the woman who made me feel good about me we have the potential for it all to end sour and have to go through more turmoil

but thanks for the words of help

hopefully god is with me

Many of us are with our partners, but at one point or another, all of us went a really, really long time without seeing our loved ones. When my now-husband and I applied for the K-1 last year, our last visit before applying was in January 2012, and we didn't see each other in person again until November 2012 when he moved here. So yeah, I completely get the worry, the sadness, the depression, the hopeless feeling, the feeling like the process will never end. And with any immigration, there is ALWAYS a risk that the applicant won't be approved. But you have to focus on the reasons you SHOULD be approved. Do you have a bonafide relationship? Do you have proof to back that up? If the answer to those questions is yes, then focus on that. You have no control over what the CO is going to ask or how much scrutiny you will face when interviewed- no one does. Better to focus on the stuff that can get you approved instead of the stuff that might get you denied.

Very true. Only answer what they ask. Do not offer info that's not being asked of you.

trust me i stay and stay positive i have done all my life

but after being positive for so long it does wear you down

i was born a fighter and keep fighting the bitter end

i guess recently i have been knocked down and im trying to make the count

hopefully i will get back up before the count of ten and fight back

if we do have to do the waiver least we have genuine hardships that we can prove

and the fact its only one caution and nothing else against me might make it a little easier

we shall see

i will keep praying and keep trying

Fine, you'll get a denial. Sounds like that is what you are trying so hard to confirm, so just go ahead and expect it, and move on.

You have to go through the visa application process anyways before you can even do a waiver. And a waiver, unlike the regular visa application process, should always be done with a lawyer.

So, now what? Do you allow this to continue to sour your attitude and drag your lower lip to the floor, unimpressing your soon to be spouse? What will she think? How will she think you will handle any type of crisis in the future, when you two are together? Very few women like to be married to someone who takes such a defeatist attitude towards such problems. No, instead, they want someone who is strong, and can take their problems with a head on attitude, saying, "we will overcome this." They need someone like this, someone with confidence, abililty, and strength to get through the problems, a problem solver.

I challenge you to pick yourself up off the floor man. Stop giving up when the count is only at 3. Get the hell up, smile, and tell your fiance that everything will be alright. That you two will be together in the end, no matter what happens, and then, dude, GET TO WORK. Stop the whining. Nobody wants to hear it, especially the person who you promised to take care of.

maybe you are right

maybe i need to look at the fact its just a caution for something so petty i was never convicted of anything its not a vile crime just a practical joke that went wrong

they might see mercy on me at the interview if i get to tell me story you ever know i guess

but i will be prepared for a waiver though

and when / if that times comes yes we will get a lawyer and get through it im not giving up just my fault of expecting the worse i know others get through for worse i get that

but its just my darn luck and more worried about the missrep on the vwp where i think the denial comes in

but your right i have to stay strong cause you never know god maybe with me and the CO might show some mercy on me as its just a caution

i hope thats the case but either way we have to do what we have to do
