All,

I have not seen people taking about i-864ez. As per my understanding from department of state web page - http://travel.state.gov/visa/immigrants/info/info_3197.html (5th option in the IF clause), if you are sponsoring one person and you have only one income you have to use for I-864ez.

Is my understanding correct?

I am the petitioner and sponsoring my wife for Immigrant visa and has only one income.

We used the EZ version as well. It's awesome if you qualify to use it!

Thanks all for your reply! I also qualify as i got all "Yes" for the below three conditions (IF..), so I will use I-864EZ. It also says you can send it by e-mail as an attachment, if you have joined E-Mail Elctronic processing program (see the bold lines below). What is E-Mail Electronic Processing program #5 & #6)? How can I participate this program?

IF...

All three of the following are true:

· You filed a Form I-130 petition, for your relative

· There is only one applicant on the Form I-130 petition, and

· All your qualifying income comes from a salary or pension and shows on one or more W-2 Forms that you receive

THEN..

1. Complete an I-864EZ. on your computer using CAPITAL letters

2. Review the I-864EZ Checklist

3. Print the completed form

4. Attach the bar code sheet, and

5. Mail them to the NVC unless you have joined the E-Mail Electronic Processing program, then…

6. Scan the I-864EZ to Portable Document Format (PDF) and send it as an e-mail attachment to NVCElectronic@state.gov. Sending physical documents to the NVC will delay the processing of your case. When sending completed forms to the NVC do not include instruction pages or any other sheets which do not carry information you entered while completing the form.

India is NOT an electronic processing country. You must send everything by regular mail or courier.

Is it not AOS related to the petitioner and NVC? I am not sure how the consulate comes into the picture. I can understand for DS-230 it linked to the country specific consulate.

Are you guys agree with me?

Not sure what you're trying to say?

The NVC does the document intake for the DS-230 and related documents - the Immigrant Visa (IV) package - beneficiary/applicant

The NVC does the document intake for the I-864(ez/a/w..etc) and related documents - the Affidavit of Support (AOS) package. - petitioner/sponsor

The NVC makes sure you have all the documents required and have filled everything out correctly then sends everything to the consulate who makes the final determination based on all the evidence.

Hi NLR,

Thanks for your reply. I kind of understood the preocess now. Because NVC forwards all the documents to respctive consulate, they need make sure the consulate has electronic processing or not. If the cosulate has electornic processing then I think we can send all the documents to NVC by mail. And in my case India is not in the list, so I have to send all the hard copies to NVC by mail.

Right?

where do you find the list of countries that participate?

K1 - Filed March 2011

- Denied March 13, 2012

- Placed in AP March 14,2012

- Sent back to USCIS November 2012

- Expired March 2013

MARRIED MARCH 15, 2013

1-130 Approved 3/3/2014 :-)

Finally made it home 3/18/2014

I have an approved I-130 petition for my spouse, and we are working on the DS-230 on the road to a green card. If my under 21 years old stepchild, who is in the US on a student visa decides to adjust his status (and file I-130/I-485 concurrently), can I use the I-864EZ? I did use the 864EZ form my spouse's petition.

The I-864 instructions for which form to use are confusing. It states I can use the I-864EZ if "the sponsored immigrant is the only person immigrating based on the underlying visa petition." Would my stepchild be considered a separate visa petition from the I-130 already approved for my spouse? In other words, is he considered the only person immigrating under his petition? I would like to file the EZ form again, obviously, if possible.

(I put a similar post in adjustment of status forum but no one has replied and my deadline is rapidly approaching.)

Yes you should be able to. For instance, if your step-son and your wife were both in China and you filed both of their petitions together, then when they were approved you paid the AOS fee for both, you couldn't use the i-864ez because two people would be immigrating at that time.

But the way you describe, they're doing it separately so that should be okay.
