Wife might be pregnant, does this affect the I-130 etc????

In regards to the DNA, it will depend on the embassy. Nigeria is one that would likely ask for DNA from both parents. Some countries wouldn't bat an eye.

Congratulations! It is actually maybe the best evidence of proof of your relationship so it will help. If I understand correctly, you have not submitted the I-130 yet so the baby will almost certainly be born before your wife is approved so you should as others have said familiarize yourself with the CRBA. Also, airlines will not let women typically fly late in pregnancy so you will have to take that in account as well depending how far the consulate is from your wife and when she might want to enter the US.

Hi, in terms of the CBRA evidence, what you have should be fine. I've lived in Australia with my husband since right after I graduated college, so I was a bit worried about that requirement when we got my son's CBRA, because I had never paid bills or taxes or anything on my own. I just provided my high school and college transcripts and that was enough.

We weren't required to give a DNA test to the Sydney consulate, because we're married and have been for a while, but I'm not sure what the requirements for Poland are.

I gave high school transcripts and a couple years worth of W2's. No DNA test as we were married before he was conceived and born. The only difficult part was getting through security at the consulate. If you aren't there in person, you have to fill out an affidavit and send original proofs as well. Are you a native American, or naturalized?

Hi, from what I can remember we submitted our marriage certificate which showed we were married before our child was born (although I am not sure if the date of marriage was significant ). Our daughters long form birth certificate that listed the both of us as her parents...and my husband sent copies of either his tax returns or w2s that proved he met the residency requirements.

I would try an file an expedite request after proof of pregnancy to try to get her to give birth in the USA under your health insurance-unless you have none

Unless the child would benefit from having a polish passport and an american passport

The child is mine, there's not doubt about that. Do you think we'll need a DNA test? I'm hoping not. There would be an advantage to the child having an American and Polish passport, so we'd prefer to have him/her in Poland.

It will take about a month to get the crba and passport mailed to you, and we still haven't received our son's social security card. They said that could take a few months, as ours is printed in the Philippines. Not sure how that will work for you.

From the US Consulate in Krakow website;

The following items are necessary for documenting a child as an American citizen:

  • Original copy of the Polish birth certificate (the long version = Odpis Zupelny Aktu Urodzenia)
  • Original copy of the parents' marriage certificate
  • Proof of the termination of the parents' previous marriages (death or divorce certificates)
  • Parents' passports
  • 1 photograph, 2 in x 2 in (5cm x 5 cm), with full-face shown and a light background
  • $100 USD or Polish zloty equivalent for a Consular Report of Birth Abroad
  • $105 USD or Polish zloty equivalent for a passport
  • If the child is born out of wedlock, Form DS-5507 (PDF 132.43 kb)
  • You may choose to submit a Passport application for a child(form DS-11)

Proof of physical residence in the U.S.:

It is the American citizen's obligation to demonstrate that they meet the physical presence requirement listed above. The documentation you provide is critical to proving your physical presence in the United States. Examples of appropriate documentation include: high school or college transcripts, social security statements showing the years worked in the U.S., W-2 forms, and current/former passports with entry and exit stamps. In addition, American citizens can obtain a copy of their travel records by contacting U.S. Customs and Border Protection at the following address: 1300 Pennsylvania Ave, NW; Attn: Mint Annex Building, FOIA Division; Washington, DC20229.

While it is only required that one parent be an American citizen, both parents listed on the birth certificate and the child must be present for a Consular Report of Birth Abroad to be issued. Once this document has been prepared, you can apply for a passport for your child.

Yes, I know we don't send anything and read the Warsaw embassy links about the process before you gave me anything. I likely won't be able to go with my wife to the embassy because of my work. She will go alone. That's what I meant by sent, in that I have to send everything to her. We won't be going to the Krakow consulate, but the Warsaw consulate because it's closer and has a better reputation. I already knew we needed its Odpis Zupelny Aktu Urodzenia, our marrriage certificate and our passports. Thank you.
