Immigration Lawyer downloads and sends wrong form????

We sent in the I-129f to the VSC on 11/20/06. On 11/27/06, the application was sent back saying that the form sent was out of date, and the revised one needed to be sent. This was clearly the fault of the immigration lawyer who downloaded the wrong form. Will this affect how the USCIS views the case? Will they see it as the fault of the Lawyer or will they view it as our fault????

i don't think it will really matter. i sent in my packet with a money order that hadt he wrong date

on it. i don't really believe they will care as long as the right form is sent back in.

but this is just my opinion.

03/17/2007 tracey arrives from new zealand

05/26/2007 tracey and i are married

02/04/2008 mailed off AOS

I doubt they have any interest in whose 'fault' it was - they just want you (or your lawyer) to re-send everything with the correct form. Wouldn't worry about it affecting the case at all - they just can't accept the out-of-date forms beyond a certain cut-off point. If you go to the USCIS website, you can get the most up-to-date forms from there. :)

2005 - We met

2006 - Filed I-129F

2007 - K-1 issued, moved to US, completed AOS (a busy year, immigration-wise)

2009 - Conditions lifted

2010 - Will be naturalising. Buh-bye, USCIS! smile.png

You might need a lawyer but not that one.

The biggest effect this will have on your case is a delay. Keep using this dude and you're likely to have more of them.

Agreed completely. If he/she can't even figure out the correct version of the form to file, god help you when it comes to providing anything more complicated than reading the version date! I'd thank my stars I got this warning so early in the game, personally.

I'd imagine it won't cause problems for the rest of the journey-- Several members have made mistakes that got caught and all it required was sending back the correct info/form, and sometimes they don't even notice on some things (I had the wrong date on my check and they just stamped the right date over top, for example). Good luck!
