Any point in filing a K3?

The USCIS line is often called the misinformation line for a reason. Prior to local offices becoming involved I would respond to a USCIS phone representative denying the I-130 not being joined with the I-129F was bald faced lie (there is an official USCIS memo issued in 2006 that specifically addresses the joining of petitions - Google is your friend).

Since local offices have entered the mix, I haven't heard enough experiences from others to know one way or the other if the two petitions are joined or not. If someone wants to go ahead and see what happens (as other posters in this thread have so indicated) then that's their own prerogative.

April 28, 2011: Received NOA1 via text/email, file routed to CSC (priority date April 25th)

May 3, 2011: Received NOA1 hardcopy in mail
July 26, 2011: Received NOA2 via text/email!!!
July 30, 2011: Received NOA2 hardcopy in mail
August 8, 2011: NVC received file
September 1, 2011: NVC case number assigned
September 2, 2011: AOS invoice received, OPTIN email for EP sent
September 7, 2011: Paid AOS bill (payment portal showed PAID on September 9, 2011)
September 8, 2011: OPTIN email accepted, GZO number assigned
September 10, 2011: Emailed AOS package
September 12, 2011: IV bill invoiced
September 13, 2011: Paid IV bill (payment portal showed PAID on September 14, 2011)
September 14, 2011: Emailed IV package
October 3, 2011: Emailed checklist response (checklist generated due to typo on Form DS-230)
October 6, 2011: Case complete at NVC
November 10, 2011: Interview - APPROVED!!!
December 7, 2011: POE - Sea-Tac Airport

September 17, 2013: Mailed I-751 to CSC

September 23, 2013: Received NOA1 in mail (receipt date September 19th)

October 16, 2013: Biometrics Appointment

January 28, 2014: Production of new Green Card ordered

February 3, 2014: New Green Card received; done with USCIS until fall of 2023*

December 18, 2023:  Filed I-90 to renew Green Card

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal

ya, Jeff_something had the I-130 joined.

His I-130 was in the Dallas local office and was yanked for the MSC office, where the I-129F and I-130 were adjudicated at the same time.

There was a different clock on the I-129F, so I can't say what's what on that, for him - but - it was recent. Find the Dallas local office thread, he's in there a bit. Once you find him, you can follow his other posts.

I would much rather take my information from the USCIS or other official source than going by the rumor mill here. I have asked questions, that pertain to my specific case. I know where my case for CR-1/K3 will be processed and I even know my local office in case something happens and they do get transfered there. My intention isnt to argue or debate, it was to point out that the K3 is not obsolete and that your I-130 will not be placed in the back of the line if you apply for a K3. And when I refer to USCIS thats the website that my K3 case has been updated on. So thats the first place I called. You say they dont process K3 visas? Apparently something is done with them there or I wouldnt get any updates from the website right? Im no USCIS or NVC advocate. So I will take what they tell me with a spice rack, Ill also take all those rumors here on VJ with that same spice rack. Im sure there is more bad information floating on this forum besides what I pointed out. But if someone wants to file a K3 visa and all it gives them is a little hope then why take that away from them by giving bad advice? At the least if anyone makes an input it should be encouraging. After all, we are all in the same boat no matter what visa type we file. And we all have the same goal, to be with our loved ones asap. Discouraging someone from filing a K3 because its obsolete or will place your 130 at the back of the line is ridiculous.

Also please go to this page: http://travel.state.gov/visa/statistics/nivstats/nivstats_4582.html you can see the visa stats per year. If you look at 2010 vs 2011 you will see a drop from over 3000 K3 visas issued to only 668. in 2012 there was only 290 issued WORLDWIDE. Now compare those statistics to these http://www.travel.state.gov/pdf/FY12AnnualReport-TableII.pdf. In 2012 there were 88769 spousal visas issued (IR1/CR1). That means K3 visas were issued less than 0.76% of the spousal visas worldwide.

Obsolete:

No longer used or out of date.

If you want to try for it then do it. By all means. I've always told everyone that the CR1/IR1 is a superior visa but if they want to send the I-129F to go ahead. I let them know the facts as I know them. There they are. Enjoy. :)

That dosent sound obsolete at alll. Processing my visa petition is dealing with it to a certain point. But yes, i do know the differance. Can one of you experts tell me when my visa will be approved? Smh lol

Not until after either the I-130 and/or the I-129F petitions are approved and are sent to the NVC. :D

My first infopass at Irving TX office the lady at the window asked me why I didn't file a K3 at I-130 NOA 1. She got up and even talked with her supervisor and came back and said I-130 was so far in process that the 129f would probably be cancelled which it was I'm at NVC now just sent AOS package today

Only things that concern me with that

1. its from 2010

2. its from visa journey news

It would be more interesting if it was recent or from say a USCIS bulletin, major news outlet etc. Old news is only good for so long. Either way thanks for posting.

i was told today by a page on facebook called uscis processing times that since i already filed i-130 i cant file k-3 but on uscis page it says you can...so confusing :( has anyone filed it after they have filed i-130 and did it help you...thanks

You can file the I-129F anytime after getting your NOA1 from the I-130 for free until the I-130 is approved. I believe you'd need the paper copy to do so but I'm not sure.

Just understand what happens with a K3. It's a multi use visa so the beneficiary can travel and stay in the USA for up to 2 years. But until you file the AOS (adjustment of status) the beneficiary cannot work. They will need EAD (employment authorization) to work and that is filed with the AOS. It's $1070 for AOS to get the green card. Also if the I-129F arrives at the same time or after the I-130 the NVC will administratively close the I-129F and you will be on the CR1/IR1 path no matter what you may have wanted. In the end the visa costs about twice as much and takes just as long to be processed.

There are a lot of folks here on VJ that are quick to give mis-information. Stating K3 is obsolete, your I-130 will be pulled and you'll loose your place in line etc. Fact is the K3 IS valid..just go on the USCIS website and look. And the whole bit about pulling your I-130 and placing it at the back of the line is non sense too. If that was the case then every time you went for Infopass or made a call wouldn't they do the same thing? This is a good website to share info, share experiences, give reviews etc. But it seems that its also a good place to get mis-guided by VJ rumors. I say if you want to know something official, than get your info from someone official. Can anyone show me on the USCIS official site where it says K3 is obsolete? Can anyone show where USCIS states that my I-130 will be pulled and put in the back of the line for filing a K3? Nope... Anyway good luck on whatever visa you decide to file! smile.png

I was told this afternoon that they are re-starting the K3. My lawyer asked me to come in and sign the papers so they can submit it tomorrow. I am an April filer. He said processing time is 5 months. I guess its like starting over because I am just at the 6 month mark with my I-130. He thinks its worth it to file now. So here we go....

I guess I'll be hanging out on the K3 threads too.
