Wife is now a K3 what to do with the I-130 for the CR1?

My wife is now here as a K3, do I need to contact the NVC to inform them or do I just file the 485 and CIS will take care of everything? TIA
You don't need to do a thing about the NVC. Don't send any more correspondance or fees to NVC. Your wife is here on a K-3 so what you need to do is send a copy of the I-130 NOA-2 (Approval notice) and send it with the adjustment of status package (I-485).

Have they approved your I-130? If not, then NVC wouldn't know anything about it and you'd just confuse them.

If she's adjusting status then I think you have to wait until the I-130 is approved then just send in the AOS applications with a photo copy of the NOA2 from the I-130.

Timeline

If the I-130 is already approved, you will need to send a copy of the approval notice with the I485 application. If your file is already at the NVC, they will send it back to the service center once your I485 begins being processed.

Thanks for the quick replies. I thought Iread here somewhere about notifying the NVC so I asked. Anyways, the I-130 is already approved so I will just file the I-485 w/ the NOA of the approval. Another question do I need to file another G-325 with the 485? I ask here cause I can't get the same answers with CIS when I ask the answers always change, at least here the people giving answers have gone through the process themselves and can empathize. TIA

12/14/06 - case number assigned

12/25/06 - DS3032 & AOS Fee Bill Mailed (phone system updated 12/27)

12/27/06 - emailed choice of agent; 12/29/06 - received email from NVC confirming choice of agent!

01/01/07 - NVC generated IV Fee Bill (postmarked 1/17 though!)

01/03/07 - returned AoS Fee Bill via Priority Mail (James' shortcut)

01/15/07 - NVC generated AOS package

01/22/07 - received IV Fee Bill - overnighted back to NVC same day

01/27/07 - recieved I864 package; 01/29/07 - overnighted I864 to NVC

01/29/07 - DS230 generated (phone system not updated, email response 2/5/07)

No, a K3 does not have to wait for I-130 to be approved to apply for adjustment of status.

I had to wait when I was adjusting in Charlotte. They won't do anything with it until they have notice that the I-130 is approved, so technically, you can't really apply for AOS until the I-130 is approved.

Its probably changed, I think the Missouri office is doing most everything now? But when I filed, the district offices were still doing AOS and most of them wouldn't do anything without an approved I-130.

You did it a while ago, when the different local offices had 3 different policies. Since things were consolidated with all applications initially going to the NBC, the policy that survived is that I-130 does not have to be approved or re-submitted.
