Divorce Decree not attached in I-129F application (K3)

Hey Guys,

would there be a problem if my husband wasn't able to attached his divorce decree in the I-129F application for K3?..He was able to attached it in the I-130 application together with our Marriage Certificate and other pertinent documents but he said it's not being required in the I-129F for K3..

I just want to have a clear insight.

Our Timeline:

------I-130---------

Oct. 10 2006 : Sent I-130 to NSC..USCIS transferred it to CSC later on.

Oct. 12 2006 : Package delivered

Oct. 17 2006 : NOA1

Oct. 21 2006 : Received NOA1 thru mail

Feb. 22 2007 : APPROVED!!!

Feb. 23 2007 : touched

------I-129F---------

Nov. 14 2006 : Sent I-129F to Chicago Center

Nov. 15 2006 : Package delivered

Nov. 17 2006 : NOA1 received date

Nov. 21 2006 : NOA1 thru mail..MSCXXXXXXX case number

Nov. 27-28 2006 : Touched without CS changed

Nov. 29 2006 : Case Transferred to CSC

Nov. 30 2006 : Email Notification from CRIS regarding transfer

Dec. 05 2006 : Email Notification from CRIS informing that I-129F is now pending at CSC

Dec. 06-07 2006 : Touched without CS changed

Feb. 02 2007 : Email Notice: Request for Additional Evidence

Feb. 03 2007 : Touched (on a saturday?!)

Feb. 08 2007 : Recieved RFE notice on mail (found out husband forgot to attached his divorce decree)

Feb. 12 2007 : RFE reply sent

Feb. 20 2007 : Email Notice: RFE Reply received

Feb. 21-22 2007 : Touched

Feb. 23 2007 : Email Notice received : APPROVED on . Feb. 22, 2007!!!!

Feb. 28 2007 : Received NOA2 in mail advised that case was already forwarded to NVC

Mar. 2 2007 : Package sent to USE MNLxxxxxxxxxx

Mar. 15 2007 : Interview Sched viewed online

May 18, 2007 : St. Luke's Appointment

May 25, 2007 : INTERVIEW!!..our 5th wedding anniversary!(APPROVED!!!!YAY!!)

June 8,2007 : VISA DELIVERED at 12:15 PM

It appears there would be a problem.

I have the exact same revision as the other poster. Try reading question #7, letter D where it says:

If either you or your fiancé(e) were married before,give copies of documents showing that each priormarriage was legally terminated.

""

But Question 7 clearly refers to "What Documents Do You Need to Prove That You Can Legally Marry".

My reading of the instructions is that if you are married, it is not necessary to submit the divorce papers at this point - it will be needed later though.

It does not matter much at this stage whether he should have included it or not because he did not. If they need it (and I presume they will), they will ask for it via an RFE.

You wont encounter any problem regarding non-submission of the divorce decree papers in your I-129 application. The same is required in your I-130 application hence, you do not need to worry..

The I-129F comes with instructions. They state quite clearly to submit evidence that all prior marriages have been terminated.....you can expect an RFE.

where is that picture about reading the instructions when you need it???

I finally got rid of the never ending money drain. I called the plumber, and got the problem fixed. I wish her the best.

Interesting. The same version is in front of me, and the requirement is there. Written in broader terms to cover all possible situations, but when divorce is the situation the divorce decree is the appropriate document to submit.

Thank you GUys for the inputs..I guess it's too late to worry now since the application was already submitted..If USCIS will consider not having the Divorce Cert attached in the I-129F and go on with the approval then thank God for that but if they'll not, then we'll just have to wait for the RFE and do what's required to do..My husband's argument is that the Divorce Certificate is only needed for I-129F K1 application as a proof that someone can legally marry (again) and since we're already married, the certificate doesn't matter anymore..

Another thing is he's been following the VJ Step by Step guide to K3 visa application and in the mailing assembly guide there's no Divorce Certificate being included in the list and it even states that Marriage Certificate is optional..hhhmmmm.. :unsure:
