Divorce and mariage certificate

Timeline

I received packet 3, there is one question I confused. It state: "If you or your fiancee were married previously, obtain one certified copy of your marriage certificates and one certified copy of hte divorce decree......"

Both of us were married previously and divorced. We know both of us have to submit divorce certificate. Does anyone could tell us if both of us have to submit marriage certificate.

Yeppers. I was married before and had to submit both certificates. Remember, if they're in a language "other than English" you'll need my nemesis.... certified translations!!!

See, now this question and reply just confused me too!

The checklist only asks for Divorce decrees. It does not say anything about Marriage certs. The only place that mentions Marriage certs is the document titled "SUPPLEMENTAL INFORMATION ...... DOCUMENTS", and it is my understanding that this is not K-1 specific.

Regardless, I just emailed Montreal to ask them. Will let you know their response.

Mar 17 - got email, attached to one case number only, saying that my A number was changed relating to the I-130 filing

Apr 21 - Biometrics appt.

My Checklist reads:

DIVORCE AND DEATH CERTIFICATES:

If you or your fiance(e) was previously married, you are required to present a certified copy of the termination of any prior marriage, for example, a death certificate or a final decree of divorce or annulment. The certificate must show that it is an extract from official records and must bear the seal of the issuing authority."

I guess at some point they must have changed their wording. You are going through Montreal too, right?

Ditto, we're going through Montreal. In any case, prepare and get those doc's ready my friend.... would not want you having any problems because you didn't have them. Keep us posted.

I will definately update when I get a return email.. I'm thinking though that the rules might be different for you and me because you are 'DCF'-ing and I am 'K-1'-ing. Maybe?

Just got the reply.. wow that was fast!

The form titled "SUPPLEMENT BLAH BLAH BLAH" is NOT K-1 specific.

I DO NOT have to have a previous marriage certificate, only the divorce decree.

Please note that for anyone referencing this... I am going through Montreal - apparently Vancouver is different.

I had emailed Vancouver to ask them if the marriage certificate was really required when we have the divorce decrees. They said yes. In the end, I was only able to produce one marriage certificate, and couldn't get the second one. So I held back the one marriage cert I did have, and only offered up the divorce decrees. They never asked for the marriage certificates.

However, just because they didn't ask me for them in the end, doesn't mean they won't ask you... if you can get your hands on them, do so. Because in their email to me, Vancouver definately said they were required.

04/13/06 - I-129F mailed

04/18/06 - NOA1

08/30/06 - NOA2

09/26/06 - received at NVC

09/27/06 - forwarded to consulate

20/11/06 - visa in my pocket!

14/01/07 - POE

13/04/07 - marriage

27/04/07 docs sent in for AOS, EAD, AP

26/06/07 - biometrics appointment

02/17/07 - AP and EAD arrive

03/03/08 - Infopass - where the heck is my AOS interview?? No one knows!

I didn't read the Vancouver K-3 cheklist carefully, and didn't bring my husband's previous marriage certificate (though we had the divorce agreement). It wasn't a problem for us, but you never know.

Whew...thank the gods we went through MTL. There was NO way I would have found my previous marriage certificate. It seems obvious though, if you have a certified divorce decree wouldn't that be indicative of a previous marriage WITHOUT having to show a marriage certificate? :blink:

I went through Vancouver. The checklist from Vancouver indicated past marriage certificates and divorce decrees. I brought both. If they ask for it, and you can get it, do it. Wouldn't you hate to end up having to have it and you didn't "think" they needed it? Don't give them any excuse not to issue that visa, that's my motto!

I've been married 3 times previously and we're going through Montreal. Early in the process I send away for certified copies of ALL marriage and divorce certificates.

Why take chances? Do it NOW because it can take months to get some of these things.
