Hello VJ's:

I became a permanent resident on december 27th, 2010. I applied for ROC on September 28th, 2012 and got approved on April 17th, 2013. A friend of mine got me confused about the filing date of the N400 based on marriage to a US citizen, I thought I will be eligible to apply on September 28th, 2013 but he told me I should apply 90 days before April 17th, 2013.

If someone can help me and tell me the right date because I'm confused.

Also do I sill have to send proves with N400 as we did for the ROC process?

I got speeding tickets before the most recent one was in april 2013, All of them are less than $500 fines. All of them are paid and the last one is dismissed. Do I have to submit proof that they are paid? Do I have to answer yes or No for that question?

Thanks

If your LPR since date is 12/27/2010 then you can file 90 days before the third anniversary of that date. You must be married to the same USC for 3 years, they must have been a USC for the previous 3 years, and you also must have been a LPR for at least 3 years. There are also the residency requirements and time within the US verses outside teh US that you must meet. Have a look at this document starting on page 5. It has all the answers you will need.

Good luck,

Dave

if the first date on your first green card

is

december 27th, 2010

then add 3 years, making

december 27th, 2013

then subtract 90 days from that

and then study a calendar when yer able.

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !
Ya know, you can find the answer to your question with the advanced search tool, when using a PC? Ditch the handphone, come back later on a PC, and try again.

Your friend is wrong. It's based on the "resident since" date on your GC which from your post is 12/27/10 so you are correct. You are eligible 09/28/13 (which is 90 days before then).

The evidence for N-400 isn't as strong as ROC no. It's actually pretty easy. Have a look at the N-400 thread in my signature.

You don't need to provide evidence of the traffic tickets (per the instructions) but I would list them just to be safe. It doesn't affect your process.
