Yes ,,, i was in egypt too?

So they didnt tell you anything about that app.?

Was that simple ,

I have lots of time til i- 130 approved , that is my only nightmare

So please tell me what they asked you in detail

If possible?

What he will do ?

I don't think the lawyer can do much right now. You still have to go through the I-130 process, and you do not need a lawyer for that. And the previous tourist visa already occured - the consulate has it. The lawyer cannot do anything to fix that. The lawyer will be needed if you get denied and have to go the waiver route - that is when the lawyer will help. Edited by Leon & Mylen

So not exactly accidental?

They lied to obtain an immigration benefit, the lie was material which is misrepresentation.

Malicious, well that is not an immigration term. I could visualise others going through that Consulate would think it was.

Not to quibble, but they didn't lie for immigration purposes, they lied for a non-immigrant tourist visa. In the end, that probably won't affect the outcome, but it is relevant.

To the OP:

As someone else just posted, go through the I-130 process, go through the NVC process, she'll probably make it through to the consular interview if your packages are good, and then at the interview, you'll find out if it's an issue or not. There's really no other way to tell. Towards the end of the NVC process, consult a lawyer if you find that after researching waivers, that you don't think you'll be able to put the package together yourself. It's lengthy and requires a lot of research and documentation. I'm on page 11 of my hardship letter for a waiver right now and still have three more major topics to discuss.
