lying in tourst visa application 3years ago.

Yes, you need to get a lawyer. I saw several threads whewre they pull prior tourist application and charge with misrepresentation. I can find some if you like. Facts:

1) You were married at the time of application

2) In the visitor/tourist visa application there is a specific question asking: "Do you know anyone in US". You answered "No"

3) on the form DS230 which you have to fill out before your spousal visa interview there is a question: "Have you ever applied for a US visa and when?". They know the answer and you will have to answer "Yes"

4) You can be sure they will pull out your prior visa application for sure tor eview and will match your marriage date and your misrepresentation answer

5) You will get a ban.

I would hire a good lawyer.

if they are filing a 130, why are you quoting a ds-156?

Yeah I realized that, but couldn't edit, as I was doing further research afterwards and came back too late. Thanks. As far as the forms for the I-130, I couldn't see any question where they ask about previous denials. They do for K-1, in the above form.

Well, DS-160 (then DS-156) always had the question where they ask you to list relatives in the U.S. and their status - USC, LPR, student, visit - did she lie on this one and said she didn't have a husband in the US. Did she write down she is single and not married?

it is rare on this site for members to recommend a lawyer, but in your case .. several members have already said it.. you need a lawyer.. your case involves false/misleading statements made in the past and someone who is more knowledgeable in the legalities of navigating this kind of issue is necessary.

any misstep here would cost a lifetime ban.. are you ready to risk that?

Did you lie about your marital status on your visitor visa application too??????

If you were honest, then you are really wrong for telling the OP not to worry.

The OP knowingly made a material misrepresentation on a visa application, and you tell her not to worry. Your advice is truly bad. You are essentially advising the OP to hope and pray the US does not discover the material misreprentation.

Did you even look at the link that was provided which should cause the OP to worry a lot?

Do you even know what a material misreprentation is and the conseques? Obviously not.

I am being firm because your post is dangerous and naive. If the OP follows your advice, she will have a life time ban. At least a lawyer may be able to help give her a chance to immigrate to the US.
