Back in August of 2004 I applied for a K1 visa for my fiance, after an unsucessful interview at the consulate in December, they finally gave her a visa in 2006. After all that wainting I got laid off from my job, so did my parents my brother moved out, and my mother makes mininmum wage, so we decided it was best we separate for a while until I can get back on my feet. Now, everything is good, what can I do to get her back over here? Do I have to go through the process all over again? Or can I just speak to the consulate. Her Visa expired in October, and she went back in July.

From what I understand, if the Visa has expired then you have to start over. However, I'm not sure. Have you tried contacting the consulate and asking them what to do? This might be a starting point.

I'm also fairly certain there will be someone else to come along with more substantial information that I've posted. Best of luck to you both.

You said her visa expired in October and she went back to her country before that, in July, right? July before and NOT July after I hope.

You'll most likely have to re-apply for the K1, if you two haven't gotten married. As far as I know, there's no picking up where you left since she went to US, didn't get married, and left.

You have no option other than to restart the process....

Do you guys suggest just getting married and apply for that visa instread now, instead of having to wait another two years?

From what I have heard is that DR is very slow.... DCF is usually fastest but the longest part of your delay appears to be the consulate.....
