Hello everyone,

Until now there's still no update about our petition ,however me and my fiance discussed and prepare the future paperwork.. I have a daughter ( 7 yrs.old) and will fly with me with K2 visa. And as we have to apply for AOS after we married, we dont know if we adjust her status too or proceed to the adoption... My daughter is using my last name, and she's very close to my fiance... Even he came home on december and gave her big birthday party, and week after the baptism of our son..( me and fiance have a 8 month old son). My question is, can we process the adoption right after we get married or do we need to adjust her status first before we proceed to adoption? My daughter ask my fiance to use his last name so she wont feel that she dont belong.. And she's very close to my fiance's daughter too.. They dont say " step sisters but they call and introduce each other as real sisters if they chat...

Please give us an idea what is best thing to do...( i know its too advance but we want to plan everything from now).

Adoption is governed by state laws in the US. you have to search for the requirements of the state you will live in. Many require living together for some time first.

Adoption and adjustment are completely different issues.

Adoption is governed by state law. It has nothing to do with legal status. Adoption alone does not make her an LPR or US citizen.

The k-2 child must adjust her status. She can do it for free in the application to adjust the K-1 parent.

The prospective adoptive father has to be married to 1) file AOS for the k-1 & k-2 and 2) adopt. Both processes takes months. Both could be done at the same time

Once adopted the child becomes a US citizen by virue of having an adopted USC parent under the Child Citizenship Act..

Hi thanks for your reply...mi read it here before that after they marry they actually adopt the fiancee child and they did it successfully before the aOS..

And correct me if im wrong, in USCIS website, when K1 change status it cost 1070$ and k2 has to file in separate paperwork and cost 635$. It doesnt say that its free.

We just need to research more about it..thank you so much fornthe info.
