Processing the Visa for fiancee from China

I have the I-129F already filled out, but I need to get the G-325A alien form filled out from the fiancee. However, what worries me is the length of the process to get my fiancee to come to the USA. She is in China. I'll be going around Christmas time to see her again.

but my uncle told me it may take years to process the docs even with these forms filled out and sent off. :(

Is this true?

How many years or months does it take to get her to come to the USA???

Anyone have experience with this? Also, will lawyers make this process and getting the K1 visa quicker? How much will lawyers cost on average? :help:

Hi.. It does not take years. Take a look here http://www.visajourney.com/timeline/stats.php ; add how much time it takes for papers to clear your Service center and the time from NVC to the Consulate in China.. That should give you an idea what to expect.

As for the lawyer, a good one would make sure evrything is filled out and enough evidence is sent... so USCIS wan't Request Further Evidence (send RFE) which can cause delays

Hi chris as from my experience it took me 8 months before i came here in Hawaii so i can say that it wouldnt take 1 year as long as ur documents is complete. i knew somebody who took only 4 months. And u know what we never hire 1 lawyer my fiance did the application by himself. I'l tell u the pictures of u together is very important. My fiance submit the application Nov 8 he got the approval February then i got interviewed July 20 after that the embassy put my visa on AR becoz they required me for another document but i finally got it before the end of August. So i suggest that u make a checklist before u submit all the documents and dont forget to make a copy. Okay Chris Goodluck !!!

Timeline

Prepare to spend about 9 months for the process, give or take. Although I say this not knowing anything about your case. If your case is more complicated or if you run into any issues (criminal convictions, filed other K-1 petitions in the past, etc) it could take a bit longer. For normal cases, plan on 9 months. Have a look at the timelines and search for other people that are going through the China consulate. This will give you a good idea about how long each step will be.

Yes 9 months is about the average, I sent our I-129F petetion in to USCIS the end of august, and using the NOA2 date and the timelines here I was able to get a good estimate NOA2-Visa interview of 196 days.

Use the timelines here to get good estimates of the process, and spend the time preparing.

If you are going over there next month, Prepare an accurate G-325A for your fiance to check over, and sign and date. Get a passport photo from her while you are there, and a signed letter of intent, also get plenty of pictures together, and evidence that you were together. You can prepare the rest when you return from your trip.

As for cost, This can varry depending on travel costs.

But for the USCIS, there is cost involved with filing I-129F, then later, Interview fee, Medical Fee, And associated with Adjustment of status another filing fee, biometrics fee, Fee for optional EAD, and AP. Be prepared to spend at least $2500 or more.

It's averaging about 11 months...

However... it's varied from people to people depend on which service... etc.

Lawyer will NOT help you speed up... if you want to hire one... hire someone who is ONLY work for marriage immigration which usually between anywhere from $500 to $1500.

Do some study yourself and you will be fine...

In April 2006 I filed a 129-f that was sent to vermont post Imbra that delayed things 2-3 months. In a few weeks my fiance will have interview. in china. No a lawyer will not make things quicker from what I have read. In the past my ex girlfriend and I from china also thought about marriage. I paid over 5000 to lawyer and then we decided to not get married. I recieved NO refund as he said money was spent. He did not file one peice of paper . just send a few letters to china gathering information. Try sueing a lawyer....I have been on candle website http://candleforlove.com/forums/index.php?act=idx this will help answer all questions along with this site. Unless you have difficult case you can do without lawyers help. This is a good book step by step account of the visa process http://www.amazon.com/Fiance-Marriage-Visa...TF8&s=books It will walk you through process. I would save your money for your honeymoon. This forum and candle willl help you through things . You will put a little more leg work in but no. t too difficult thing to go through. You will do a lot of the work for your lawyer anyway if you hire one.

The G-325A is a 4 page form, you need to just fill in page 1 and print all 4 pages, page 2-4 will be filled for you. You need to sign and date all 4 pages, and send in with your I-129F petition. The 4 pages are sent to different departments.

With all due respect, your uncle is misinformed (check my timeline). Yang Bo is from Wuhan and I filed my paperwork in June. We were approved a month ago and are now waiting for her package to arrive in China to that she can get interviewed and then get her visa. I anticipate the process to be completed anytime between Jan/March. Hang in there!

bump, I am leaving in 17 days for Beijing. I have printed out several copies of the I-129F and G-325A forms. I'll be bringing those along, anything else to bring along?

I have a question, do these forms need to be filled out in english or can she use chinese? Though she can write english words, but how is she able to write her address and stuff.

For the initial part of the I-129F application all of the forms definitely need to be in English since you are submitting the petition to the US Immigration service center responsible for where you live in the US. The first part of the application (the 'petition') is all done in the US, and when that is approved, the Consulate in China will send out another package of information for your fiancee to complete (the actual "application for K-1 visa"). Those from China would best be able to tell you if the second group of forms can be completed in Chinese or if they must use English, too. For the initial I-129F application submission why not fill out the forms together but you do the writing down of the information. Then she signs it. Make sure you get several photocopies of each completed form. Good luck.

Anything else. The passport photo I can get while I am there.

Whats the signed letter of intent? How do I obtain this? Is it something she would have to write out to me?
