We were thinking about it at first, but we have heard that it's better to do the CR1- Visa (cheaper and takes less time).

The embassy in Oslo only do interviews for the following:

  • students (F or M visas)
  • exchange program participants (J visas)
  • work petition beneficiaries (H, L, or P visas) who need to report to a U.S. educational institution or employer by a certain date, and
  • medical emergencies

So I guess I will have to go to Sweden no matter what Visa we apply for.

It is cheaper, but I wouldn't count on the less time part. It definitely can be less time, but you just can't count on anything being done in any time frame when it comes to these types of visas. This isn't to say the advice you received was wrong at all, just a warning to be aware that unexpected delays should probably be expected to keep you from going totally insane during the wait. It does sound like a pain that your embassy won't do the interviews, so that's another thing you have to plan for. It really sounds like you have a fairly solid base from which you are starting to make your plans. I wish you nothing but the best in however you choose to go forward, not only in the Visa process, but in your marriage and everything else.

I really enjoyed reading you get that good news!! made me smile! Some fantastic people on here giving spot on advice.

Get your papers together and file that CR1 immediately after the wedding so you'll have a much shorter wait back at your home. And if your marriage is at the start of your trip on WVP you'll have a muuuuch shorter wait!!

If your wedding plans aren't already locked in and paid for, you could look into the fiance visa (K-1) it works in a similar fashion to the spousal visa, but you don't get married until you come over here. It is considered a non immigrant visa and may get you an interview closer to where you live and be a little less hassle.

I have no idea if this is even feasible for your personal situation, but thought I'd mention it in case you hadn't considered it yet

K visas, although considered non-immigrant, are handled by IV (Immigrant Visa) Units at US consulates.

She will have to interview in Stockholm, no matter CR-1 or K-1.

Hi,

If you come on tourist visa and then stay back here it will affect your application adversely, as they might consider it a wrong intent in getting the tourist visa, that is if you get a tourist visa (if you haven't by now).

2 ways to proceed, pick one that suits:

get fiance visa, and come here, get married and apply and then you don't need to go back, if you bring all your documents from norway and have your fiance collect his before hand.

Have your fiance visit you, if he hasn't by now ( if he hasn't then that diminishes chances of getting fiance visa, and your final green card petition also). When he visits, you both should get married, and give him copies of your paperwork required, then he can file for spouse visa, (fast process).when you come here, you'll be given green card.

I'm from Norway and my fiance is American, we want to get married in America and then apply for the CR1 Visa. But how do we get married if it's illegal to get married while I'm on the Visa waiver program? How do we marry legally in the United States, without going through the K1 (fiance) visa process? We want to apply for the CR1 Visa because we have heard it's faster and cheaper. I appreciate all answers smile.png


I forgot to say that to apply for the CR1 (Spouse) Visa, you have to be married (right), but how do we get married if it's illegal to get married while on the Visa waiver program.

Hey Veer143 what do you mean by "dimishes chances of fiance visa if you don't visit" Are you talking about the requirement of having met in person at least once? Or are you talking about the requirement of a ongoing relationship? I don't think its a big deal if you can prove that you have met and and have a continuing relationship if the person comes and visits you and vice versa, especially if its less than 8 to 12 months.

No, you Should be fine... You had gotten some great info... You can get married on Vwp... You also have obviously met and can provide evidence of ongoing relationship and Norway is most definetly NOT a high fraud country, you will be just fine... Just be sure to bring evidence of ties to Norway so immigration will not think that you are intending to STAY in USA and adjust status without leaving... You'll be fine, don't let any latecomer advice shake you, your on the right track... Congratulations and enjoy!

Ya sounds like a good idea, to go to USA, have the wedding, register the wedding, then come back to norway, and have him apply for your spouse visa, and then your embassy will call you for interview, have photos , marriage certificate from USA, and your birth documents etc, plane tickets, cell phone bills (wont hurt) with conversations highlighted , picture with some detail on back ( they will keep some) available.

You should be fine. I don't know how much time spouse visa outside USA processing specifically norway will take.

That's exactly what I meant, proving without Visiting each other should be difficult so more chances of denial. If both have met ( i can't comment how many times depends on IO), share a relationship ( burden to prove lies on you). Good to carry airplane tickets, though don't be too eager to show them.
