Hey guys. I just recently got married to my fiance and we would like to commence the filing process. I am a bit confused as to what to do. Im in Jamaica now and he lives in Florida. I was planning on going to Florida on my visiting visa then we commence the filing. However, i saw where they say i would have to come back to Jamaica and file the I-130.

Please help me as I am not sure how to proceed. i do not want to mess up my chances of getting the green card.

Your husband can file i-130 now and he would need to submit a copy of your marriage certificate. The GUIDES at the top of this page will help you.

Yes, your husband can file the I-130 before or while you are int he USA, but your tourist visa only allows visiting- ie you;d need to go back home when your time on the tourist visa is up and do the medical and spousal visa interview back home.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.
