BAD CHOICES/I NEED HELP!!!!!!

hey whats up guys i filled an I-130 for my wife that lives in jordan. iv been waiting for about 8 months now and nothing, my papers are in Atlanta due to the work over load, now i got charged with a possession of marijuana before i got engaged here in alabama, now its on my record and im just wondering if this is going to affect my wife I-130....im actually pretty freaked out but im hoping someone could help me calm down haha. thank you.

ya its going to be on my record i havent been convicted yet but my court date is coming up in probably about a month or so

First, are you a US Citizen?

Second, there's nothing on any of the applications that asks whether you as the US Citizen have committed a crime. The Visa application asks that of the intending immigrant. That, however, does not mean that they don't do a thorough background check at each stage of the game. So if it takes a little while longer for them to process your I-130, or the visa application, that might be the reason. Typically Middle Eastern and Northern African countries take longer to begin with.

i am a us citizen and ya but in all honesty everyone in Atlanta have been waiting really long...but ya i dont really know cause i dont think that would be a reason to get denied

But, as you can see, they're related to the applicant, which would be your wife, and not you. I can't promise you that I'm right, but I'm nearly sure that the denials are based off of the applicant's history. Like I stated, there's nowhere on the visa application that asks about your history, just the intending immigrant's. It doesn't mean they won't find it and won't question her or give her a hard time, but I'm not sure about denying because of something the US citizen did.... unless it was more serious crime.

Um, seriously, get a criminal attorney who has worked on drug cases (or at least talk to one). I don't know how it works in Atlanta, but a simple possession charge can sometimes be plea bargained down to a lesser crime, or maybe you'll get off with nothing more than a fine. Who knows.

Even if it doesn't impact your I-130, you don't want that on your permanent record.
