DS-230 - Have you ever been charged or arrested or any offense or crime

Hi All,

a friend of mine has won the lottery for 2014 from Iran, in DS-230 , item 41 , we have "Have you ever been charged or arrested of any offense or crime ? if answer is yes , explain"

he was in prison for only political reason against Islamic republic regime, 30 years ago for two years, as some of you may know , there were many people put in prison back then when the Islamic revolution occured.

can someone guide me if this is considered as a Crime to US? (and so Yes should be selected)

or give me some similar exmpales if they have seen with political issues ?

this is very urgent to my frined, and I apprecaite anyone could help with this

If he has been in jail he has been arrested. The answer is yes because the question doesn't specify that it must be a reason considered a crime in America.

It doesn't mean he will be DQ'ed but he will be if he lies.

Yes should be selected, and where it asks him to explain he can explain.

Being convicted and jailed for political reasons didn't prevent Nelson Mandela travelling to the US when he was free again .

I think Iran is exempt from the Police Certificate, he needs to be honest, and I don't think it would cause any problem, However, I advice you to ask your friend to email the American embassy where he is gonna do his interview about the paper work regarding this issue, as I told you I think they don't want a police certificate form Iran.
