Got a RFE for initial evidence today. Still trying to determine the difference between initial and further. Regardless USCIS will be getting a phone call from me today. :)

Hey what took them so darn long to send the rfe. You said there was some rfe around your number so don they just do them all at once then at least you would have known.

Can you think what you might have left out. Plus god knows if it snail mail they plan to send hard copy. My noa1 took like 3 weeks to get to us. Yes you should call them up so they can explain. Better speak to tier2. The rfe is not even the issue but the time it takes them to send hard copy and the time it takes to update on system once you have sent back your reply.

I noticed in my group of numbers I was checking on there has only been 3 approvals the 30th was when the approved the last person. Two rfes one said we received reply on 11 July but still no approval since then. The other has not even been acknowledged and the rest of them still on initial review. Keep us updates as to what they say. On the upside of things at least someone touched your file, fingers crossed now that its something simple you can just send to them and get your approval.

I'm calling today and asking directly for a Tier 2 officer to ask them if they can tell me over the phone.

Yeah the first RFE was back in June and it was only 4 numbers ahead of me.

Honestly, I think what the RFE could be about is the Letter of Intent. I've read on here that you must put in these exact words, "I, ..... intend to marry ..... within 90 days of his/her arrival in the U.S." Is this correct? If so that will be a cause because didn't put specifically 90 days but we did put we would like to get married on September 22nd, 2013 as this is the 7th anniversary of when we met in Belgium. Both letters also spoke about how we met, how we want to be together and have a family ect.. But not saying the 90 days part may be the problem.

If it is I'm going to be quite upset to have a month delay because we didn't write "within 90 days" in the two letters we sent. ph34r.png

I think one lesson learned is that we have to treat these people like they don't have a clue. Like spell everything out in laymen terms. You put the dates there for them anyone would think they would say well ok they have a date set. Yes you should still call them. I wouldn't worry too much about what the rfe is about I would be more concerned about how long it's going to take them to get you a hard copy so you can reply in time for you approval. When you call do not take any fobbing off they tend to say wait till you get it in the post. The other thing is get the time frame for when you reply. Cos honestly these people really can be slack at times with up dating the system after they have received rfes. I saw a post just today about someone who has waited a whole month and still has not had a hard copy therefore can not reply back cos they don't know what the rfe is for. Be firm when you speak to them. Your dates are set for your marriage so essentially they are going to cause some delays if they don't let you know what it's for so you can fix it quickly.

I spoke with the Tier 2 officer and he of course couldn't tell me anything, but he was by far one of the nicest officers I've ever spoken with. As the letter is traveling from Vermont to NYC hopefully it will arrive earlier this coming week, and if it is just the letter of intent that I need to correct I can have it sent back to them by the end of the week.

All we can do is wait and follow their instructions..

I did like your said Nurseling and put an emphasis on having them quickly process this RFE and he assured me that it would be once they receive my response. Whether or not that is true, who knows. But hopefully the quickness with which they are approving applications now will also be put towards RFE's. :)

My travel plans are still a go. Luckily I have a friend who could check my mail for me. But I am going to try and ready evidence before I leave. Such as a new letter of intent stating specifically that we will marry within 90 days. Also I've printed off credit card receipts showing that my fiance was here in the U.S. this spring and I was there in Italy last summer. Although we have already submitted photos of all of our passport stamps.

It only took a few days for my application to arrive in Texas so hopefully the RFE NOA will arrive quickly as well.

My trip to see my fiance is only 10 days but still that will cause a longer delay especially if the RFE is something I can quickly respond to.

Yes that would be a great help having someone check your post for you. Like you said 10 days his not long. I remember I got my fiancée to chase down the mail man everyday for our noa1. I even begn thinking he ut it in some other apartments mail box. Turned out the darn people just did snail mail.

Yes preparation is the best thing before you travel. It's good you printed ut the statements funny enough we sent reciepts of shopping I did and paid for with my card as well as passport copies and ticket stubs along with pic of us together in Atlanta. For each receipt I stuck on a white paper and circled the dates and credit card number and the address on the receipt and I did like 100 of those then printed them out and kept originals. Photos were like 40 which were dated at the back saying who was in the pic and the date it was taken and what we were doing. I even sent magic jack receipt to them showing how we communicate i also sent my uk passport copy with stamps and my sons US passport and his UK passport copy and his birth certificate showing he was born in Atlanta in 2012. I went as far as printing the little sticky with the luggage number on their showing we had travelled. Plus all the ticket booking and receipt of payments for ticket made with Delta airline. Letter of intent for both of us saying we will marry within 90 days , passport pics for both of us and the i129f form with the index page stating stp by yep what was on each page of the package. Heck it felt like I was doing another dissitation lol. We just didnt want to leave anything to chance at all.

All you can do now is wait. Keep busy get other documents together etc.

We originally sent in 60 photos dating from 2007 until now, one with me and her entire family and her with my family as well. Also included photos of all of our passport stamps, the passport photos of both of us.

Perhaps the RFE is going to want more proof of a relationship but I doubt it. The letter seems like the only hang up.

Regarding the letter of intent. Does the letter which my fiance signs and we send in have to be the original? Meaning must it have the actual ink signature on it. Or would she be able to sign it in Italy and fax me the letter with her signature on it? The reason I ask is it will be quicker if she can just fax me the signed letter.

Regarding the letter I wouldn't want to risk another rfe so yes it must be original with both your signature in ink. If you have not received the rfe before you leave take copies with you get her to sign a few with diffrent dates so when you come back and you see the rfe you can decide which dated and signed copy suits your purpose. Whatever you do don't risk it with the scanning thing. Some adjucators maybe ok and not notice whereas others may be a little too meticulous.

Hey whats happening with yours we are noa1 around the same time I remember. You any ideas if cases around you moving in Csc?

I checked about 50 numbers before and after ours and it looks like there are only 4 I-129F petitions and they are all within about 5 numbers from my receipt number - looks like they have us I-129F filers grouped together and all show the same status unchanged since the alien reg number was assigned . All the other receipt numbers (about 100 or so) are I-130 or I-589 and are in various stages of RFE, approval, etc. I'll be happy if we hear something by the end of the month!

I checked about 50 numbers before and after ours and it looks like there are only 4 I-129F petitions and they are all within about 5 numbers from my receipt number - looks like they have us I-129F filers grouped together and all show the same status unchanged since the alien reg number was assigned . All the other receipt numbers (about 100 or so) are I-130 or I-589 and are in various stages of RFE, approval, etc. I'll be happy if we hear something by the end of the month!

Ok I had wondered if you had received your approval yet. Yes wait and see what happens by the end of the month.

4/7/2014 (72 days ) status change to card in production for EAD.

4/10/2014 ( 75 days) status changed after calling uscis regarding urgency of EAD. Also usps tracking number at 20.580pm

I don't know when to expect movement in my group...the numbers close to mine range in Alien # changes on May 28 and May 24 with many that are not I-129F petitions with one approval and one RFE and a few denials due to insufficient fees. Looks like they are working mainly on petitions with NOA1's on or before May 10 so it looks like I have a lot more waiting to do.

Hey probably by end of the month to beginning of sept you should hear something. Yes they are still on around may 10 noa1 or noa1 before the 10th. the group i was in since i got approved on the 29th july they have only managed to approve one more person making 3 of us approved and 2 rfes that still have not been approved. the rest are still unchanged. ours was a 7th may noa1. Alien reg 13th may. Hope they aren't slowing down again.
