Hi,

I have been reading on this website that it is up to the CBP officer if he lets you in the US while your petition is processing. I am waiting for my K-3 visa to be approved and I have travelled back and forth to the US from Canada multiple times. I live in Canada and the most they have asked me is where i am going and for what reason? I have always told them that I am going to see my wife and they ask me if she is american citizen and I say yes. Then they let me in the US.

My question is how do they know if you are in the K3 visa process or not?Does it show up when they scan your foreign countries passport(in my case Canadian passport) in their computer?

seems you have been lucky with your officers at POE. Somtimes they ask you to show proof of your intend to return to your country as you might just wanna stay in the US.

They do not check on your visa status, they were just nice ones I guess.

I also live in Canada and am waiting for my K3. I have been travelling back and forth to Florida almost a year now with no problems (I cross at Queenston/Lewiston near Niagra Falls). They always ask me what I am doing and where I am going. I say I am going to the airport to fly to florida so I can visit my husband for a couple weeks. Sometimes they ask me if I intend to live in the US and if I have filed any petitions. I say "yes I intend to live here once my visa is approved and I have filed an I-130 and I-129" They almost always ask to see my return flight ticket.

The only time I had trouble is when my husband was visiting and we were driving back down to Florida. When we crossed the border we had to go park and enter the cutoms office. Inside, they asked us for all the proof we had that showed him I was applying for a visa and intended to come back to get it. I showed him my approval letter and a copy of the checklist I sent back to Montreal. He took it and left for 20 minutes then came back and said "you will be in big trouble if you don't come back, you understand that right?" and I said "yes sir I will come back" and then he let us go. I'm not sure what he was doing for the 20 min and if he actually looked anything up but I was really nervous.

The best thing you can do at border crossings is be very honest because they sense liars lol.
