Hi,

My wife got a traffic violation for passing a stopped school bus, she has been throught with defered disposition and case is now dismissed, paid fine $425. Her driving record is cleared. My question is on part 10 #16

what is the input for why were you arrested, cited for? speeding ticket or passing a stopped school bus

outcome or disposition of the arrested or citation? defered disposition or dismissed

generally, traffic fines not more than $500 and not dui related need not be declared.. i had 2 speeding tickets and did not declare it on the form.. on the actual interview though i mentioned to the io that i had those tickets.. he asked if they were dui, i said no.. he said no need to declare anything

The previous answer is wrong and invites to commit perjury, which is a felony (and violates VJ's rules of conduct).

Your wife has been cited, so she has to truthfully state this -- under oath -- mind you.

While the instructions do not require to provide DOCUMENTATION for this case, you can expect the I.O. to request it, which is in his or her discretion.

this is incorrect per the form's instructions, part 10, section D, questions:

16. Have you ever been arrested, cited, or detained by any law enforcement officer

(including USCIS or former INS and military officers) for any reason?

17. Have you ever been charged with committing any crime or offense?

18. Have you ever been convicted of a crime or offense?

in the op's case, all 3 are yes. from the form the directions are:

Answer each question by checking ''Yes'' or ''No.'' If any part

of a question applies to you, you must answer ''Yes.'' For

example, if you were never arrested but were once detained by

a police officer, check ''Yes'' to the question ''Have you ever

been arrested or detained by a law enforcement officer?'' and

attach a written explanation.

You must declare all violations. Be 100% truthful in everything on your N-400. I cannot stress enough to you how important that is. Our IO had known about my husband's past car accident without him even mentioning it. (It was not his fault we were rear ended) We had copies of his driving record as well as records from the city that he had no outstanding fines. Make sure you keep your receipts of having paid your fines because you may need to prove it to your IO. Just check yes for citations and you can explain in detail at your interview. Just be honest and you should have no problems!
