I-864 and I-864 EZ

What if I (petitioner) do not qualify for the form I-864EZ? Then I have to fill up form I-864 right? IF SO what do our sponsor (my relative) fill out?

IR1/CR1 Visa: - DCF at Manila US Embassy:

03/15/2013 - Passed I-130
Never received NOA 1
03/27/2013 - NOA2 Approved! ( 12 days )
04/25/2013 - Packet 3 Sent
04/30/2013 - Medical Booked
05/02/2013 - Medical Done
05/23/2013 - Final interview day and approved!
XX/XX/XXXX - Visa in hand
XX/XX/XXXX - CFO Seminar
XX/XX/XXXX - POE San Francisco, California

yes you fill out 864 if you can't do EZ. your cosponsor would fill out 864A if they live in the same house as you or a 864 if they live somewhere else.

The main joint sponsor should fill out an I-864 even if they live in the same house. That form is used for house hold members who are combining income. So unless you are a dependent on their income tax, you're probably not combining income.

A joint sponsor never fills out and I-864ez.

Illustration of the problem of pronoun misuse. The form, to which Niki refers as "that form" is not mentioned in the post. "That form" used to combine income is the I-864a.

Sounds like the OP, needs to provide an I-864 and so does the joint sponsor. Whether anybody will use the I-864a is not possible to know with the limited information available about the household. If the joint sponsor is married though, chances are their spouse will need to sign an I-864a whether they have income or not.

Not true. Per the 864a instructions, the requirement is a relative of the sponsor who is also an adult child, parent, or sibling living at the same residence. There is no requirement to be on the same tax return. They are looking for enough income in the house to support everyone.

Yes but just because an Adult child lives in the same household doesn't mean they'll need to COMBINE income. The I-864a is for COMBINING income. A joint sponsor should fill out an I-864 even if they live with the petitioner unless neither party can satisfy the requirements on their own but can if they combine. In which case you may be better off to find a joint sponsor who can satisfy the income requirements on their own, unless such a person is really just not available or is unwilling. I can't blame anyone for not wanting to sign such a contract.

meh whatever.... pushbrk is the expert on I-864. We completed the I-864EZ because my husband makes enough money to sign the support and it's all documented in income not assets. Ya'll have fun :thumbs:
