I need some help with the affidavit of support form that I need to file out... They are asking for my recent tax returns... I have my 2011 tax returns but I haven't filed my 2012 tax's yet, because I'm currently out of the country and won't be back until after my fiance'e get's his visa approved... Now can I provide them with my 2012 W-2 form and Recent paystubs and also a verification of employment letter. I did get an extension for my 2012 tax's... Please let me know if anyone has had any problems this type of thing... or should I go ahead and file my tax's for this year before his interview is scheduled at the embassy?

Sept. 05,12: Sent I-129F Petition
Sept. 10,12: Notice of Receipt (NOA1)
April 16,13: I-129F Petition Approved (NOA2)

NVC - 2 Days
April 22,13: NVC Received
April 24,13: Case left NVC: Destination Kabul, Afghanistan

Consulate - 251 days
April 29,13: Case Received by Embassy of Kabul, Afghanistan
May 13,13: Received Packet 3 (Interview date and Medical letter)
May 21,13: Medical
May 29,13: Interview and Placed on AP

Dec. 12,13: Embassy asked for Passport and a New Medical

Dec. 30,13: Submitted Passport and New Medical to Embassy

Jan. 02,14: Visa Status changed to ISSUED

Jan. 05,14: Picked up VISA

Feb. 19,14: POE (LAX)

Moved from adjustment of status from work student tourist as the OP is not adjusting status inside the USA - is still outside the USA and waiting for a K-1 visa.

Your duplicate topic has been removed. Please do not post more than once. You are not filing adjustment of status you are filing the affidavit of support with the US consul. Adjustment of status happens AFTER the visa, After the marriage in the USA.

Its better if you have the 2012 tax return, you dont want to take any chances... for sure the consul will ask for that since its past the tax season already... for sure you can make a way to file it even though you are abroad... a we dont want any delay and problem to our fiancee on the interview date...

It would be better to have them, but they do understand that at times you can not file by the deadline. I know that the military does have an automatic extension if they are out of the country while in the military. So if this is the case then it should not be a problem.

If not just give them what you can to show your income in 2012 and be ready to answer some questions on why you did not file yet.

Consider filing even though you are overseas also, each case is different and they understand that.

Ok thanks for your help... I do work with the military and have gotten an extension on my 2012 tax's... so I will provide them with that information.
