Ok for those who have been following our saga, we had an infopass appt yesterday to get hubby's stamp on his passport.

It seems that the IO who gave us the interview on 2/13 still has the file and haven't made a move on it. According to the officer we talked to yesterday, the 60 day mark post interview is next week but we should give them at least 30 more days before we start calling and requesting a service review.

Well breathing has became a little easier knowing that the stamp is good until April 2014. At least now we don't have to live in limbo because of having an expired GC and the extension letter was on the cusp of expiring.

We are still in the dark of what triggered the RFE then interview considering all the evidence we had showing we are married, living and sharing our lives together both physically and financially.

While we were there we asked about him applying for citizenship since he is eligible for it. It was explained to us that yes, he can fill out the N-400 and send it in along with the payment but it won't go any further than that until the decision of the 10 year green card is made. The officer was quite honest about it. She said well if you have $680 that you want to pay now go right ahead BUT it won't speed up the process of getting the 10 year card produced any faster.

Now I know that you can get in touch with your congressman about helping getting the I-130 pushed along a little quicker, but I wonder would they beable to help or perhaps put our application back in the spot light since the file is here at our local USCIS office?

Anyone have any experience with getting someone to help with the 10 year greencard???

My opinion is when you file N-400 they are forced to make a decision on your 751.

If you are certain he will get his 10 year card then why wait?

Just file his citizenship papers and make them make a decision.

Good luck and thanks for the update

In truth, if I had the extra money, I'd be saving it to get an immigration lawyer in case they decide to deny the card and we will appeal.

If I were I wouldn't wait another 30 days, I would go ahead and file for the citizenship and call the congressman. I know how nice they have been and everything but this is not for you two since people who applied after you are getting approved, and your file is collecting dust on somebody's desk because they can't make up their mind. Don't worry if you have a lot of evidence for you don't be afraid they you will get denied. I've seen only one case that got denied and it was 6 years ago. File N400, call congressman tell him your situation and they will do everything for you, they are there to help you. I've seen somebody who were in the same situation as you are and called the congressman, they got approved in a week. The 680 is not for a lawyer it's for N400. Last time I hired a lawyer he was trying to make my request of evidence expire so he can reapply again and get more money from me. I did half of my AOS by myself, and I called the lawyer lazy in front of the officer and I'm doing my ROC by myself now. Nothing to be afraid of. Good luck. Call your congressman on Monday.

I know that the $680 isn't for a lawyer, BUT what I said was I would rather have that $680 to obtain a lawyer IF needed. Thanks for the advice!

I can't believe you guys are still waiting. 60 days for a response is just ridiculous. Have you involved your representative? I would see if they can assist. You've been way more patient than I would be in the same situation.

How are things aside from the waiting for the GC?

I'm hoping and praying we won't need a lawyer but if the ROC gets denied the next step is filing an appeal in immigration court and go in front of the judge. I will have a lawyer then.

Well since we were able to get the stamp on his passport at least he is able to keep on working. It's just a pain for having this lag for so long. I'm getting information together so we can get our representative involved. It's just plain ridiculous now.

Just a question, do you think you had any red flags in your file anything at all? did the IO ask you any specific questions? I'm trying to see if there is anything holding the file back. If you are eligible to file citizenship do it. call the congressman they will help you also. denial I've seen it once and that was 6 years ago. It's raaaaaaaaaaaare to deny the ROC. Good luck. Hope you hear something soon because I know how stressful that is.

I agree that it is ridiculous. People should be able to get a response within a reasonable time frame. Have they given you any idea what the issue is that is holding things up?

Trust me, he wants too but again, when we went to the USCIS on 04/09/13 for the I-155 stamp the IO told us that yes, we can go ahead and file the N-400 application and send in the $680, but that will not guarantee that it will speed up the decision for the I-751. Her exact words were "If you have $680 that you can spend, go ahead and file the N-400. What will happen will be the check will be cashed, then the N-400 application will be put aside UNTIL the I-751 application is processed."

Now we don't have $680 just laying around to give to the USCIS to just have his application pushed aside. I'd rather use the money to pay for a lawyer if that is needed if the I-751 is denied. Doesn't that make sense??

Thanks for the opinion though.

I made copies of all letters, emails any communications made between us and USCIS since the beginning of filing for I-751 and faxed it to our Congressman. Here's to hoping that something positive will happen.

Keep us in your prayers!

Actually, yoe were given mis-information...If you file N400 for citizenship while the I-751 is still pending, it will force USCIS to make a decision on your pending I-751. In other words, they will have to speed it up..

If you look on the citizenship board, there's a user named Steve D I believe, who filed N400 in march 2012 so the 751 can be decided. There's a lot of people who are now filing citizenship but still have their I-751 pending...
