You will see that for American's it says the same thing on the IRS website "you are required to file a US tax return no matter where you live on worldwide income".

It is common sense that if you have no income, you have not paid tax and have no income to file taxes on...

Well it is a requirement and if you are a US citizen nothing will happen to you but you can have trouble removing conditions, renewing a greencard or obtaining citizenship if you cannot prove you filed US tax returns for all the years you were a LPR. It is harder to prove a negative(I had no income) than to simply fill out a tax form with all 0.00, sign it and mail it in. And common since would dictate that you follow the rules and not do anything that will jeopardize your legal status. I have never been stopped by a police officer for drive 56mph in a 55mph zone but that does not mean it is legal it just means it is rarely enforced but it could be.

Actually USCIS accepts your statement about not earning enough. I personally always filed joint because it makes financial sense when you're not working... so I think USCIS would find it odd the OP's husband didn't file with her.. heck we all find it odd.

As for speeding. There's usually a "leeway" for speeding. In Australia it's 3kph. So in a 50 zone you'd have to be doing 54 to get pulled over. The point of the leeway is to account for any errors in the speed camera/your vehicle (no vehicle is perfect), and the leeway most likely varies state-to-state like everything else in the US. Not really your point, but just saying... the law isn't always black and white.

But you're right, while it shouldn't hurt anything to file with 0.00, i would think USCIS will find it odd. I suggest the OP tries getting her husband to re-file as joint before she files separate. They will see that as a red-flag unless he has a good reason.

Hi,

Today, I went to HR Block local office and asked them should I file my tax with zero income separately? They said no there is no reason to file with zero income unless you are attending at school.

You don't want six thousand dollars, give or take, by filing with your husband? Ok then! The government will be happy to keep it for you.
