Timeline

I was deported by CBP in Newark Airport in Dec, 2010 due to the following facts:

1. In April 2009, I overstayed in US for two months (did not leave US until Sept while on B1 Visa, which only allowed 3 months).

I used to be on student visa(F1) for 7 years from 2001-2008, and never realized the limit of duration of stay with B1 Visa, I assumed as long as the visa was valid (for a year), I could stay there.

2. While applying for the new visa in July 2010, I did not reflect the overstay situation correctly, only wrote 3 months on the visa application form.

I have been commuting 3 times between Sept, 2009 and Oct 2010, and these three times, I only stayed 1-3 months each time. Yet, the CBP thought it was a fraud for the overstay back in Sept. 2009.

Please see attached for the document from the CBP, they do not approve the entry for another 5 years.

Update is, I went to Germany in Jan, 2013, now my wife is pregant in US, we got married in China in Oct, 2012, and she is still a student in US now..

I want to know the chance in getting the new visa? I tried once in 2011, but did not get the B1 Visa, now I want to try with a F2 visa..

What are the chances in getting the appeal? anyone has a similar case before? Many many thanks!
