They got my AOS on the first and IV on the 3rd not reviewed mine yet either...and we wait...

9/29/06 - Started dating my husband (LDR For 5 years after 6/07)
8/22/12 - Married in Japan
10/10/12 - I-130 Sent (Japan Post)
10/12/12 - Received at Chicago Lock Box
10/15/12 - NOA1(no email, had to call and find out and recieved the hard copy 10/22/12) case at NBC
12/14/12 - NOA2(no email once again,randomly checked it online)
01/07/13 - NVC Case Received
01/25/13 - Case Number assigned and AOS fee billed(somehow NVC didn't write down the proper emails for my husband and I )
3/06/13 - AOS invoice paid!(more like the 4th,when they withdrew the money!)
3/04/13 - DS-3032 email sent
3/13/13 - DS-3032 replied to
3/14/13 - IV invoice billed
3/16/13 - IV invoice bill paid
3/19/13 - NVC withdrew my money(waiting for the PAID STATUS)
3/24/13 - IV invoice officially paid
4/03/13 - Sent AOS and IV (without PCC....doh!) package via next day mail
4/04/13 - AOS & IV Package received
4/16/13 - AOS accepted(found out by phone april 17th)
4/17/13 - NVC wants PCC(found out via phone)CHECKLIST!
4/18/13 - Sent PCC with checklist (cover letter, etc) next day mail
4/19/13 - PCC delivered
4/30/13 - Case Complete(Lord, PLEASE!!! LET ME GET IT BY THE END OF APRIL!!) #### YEAH!
5/13/13- Interview date assigned & received Packet 4
5/16/13- Package left NVC for Tokyo(I assume it will get there in 3days)
5/20/13- Package delivered to Tokyo embassy
5/21/13- Medical

6/10/13- Interview at Tokyo embassy

If you didn't file for adjustment of status, you can't continue with it. You need to send in a lot more with the I-130 petition if you're adjusting status. It was an error on their part, for whatever reason. It happened to another member here recently. You need to contact USCIS immediately and fix the error. Tell them you're applying for a spousal visa, not adjustment of status. They'll need to fix your case, and then send it to NVC. This might take a few weeks...

Well, the second paragraph states that "if the person for whom you are applying decides to apply for a visa outside of the United States based on this petition, the petitioner should file form I-824, Application for Action on an Approved Application or Petition, to request that we send the petition to the department of State NVC".

So basically, they f*cked up and now we have to go through the rigamaroll of calling god knows who to sort this out?

Who do I call? USCIS call center doesn't know anything...

12/4/2012 - NOA1 NBC (Missouri Service Center MSC) 5/22/15: Date on NOA1
12/6/2012 - Check cashed 8/26/15: Bio appointment

12/8/2012 - Received paper NOA1 10/06/15: Received Email card was being processed
12/20/2012 - Case number showed up on USCIS website
1/29/2013 - Called USCIS and case is still at NBC
2/8/2013 - Received an Email that we were approved on 2/7/13
3/5/2013 - Told file may have been "misplaced" to email NOA2 to NCVresearch
3/7/2013 - ISO at the USCIS opened a service request to try to track down
if and when the file was shipped. Should hear something before 3/26 ( so she said)

Wow, this is so much great information. Thanks to you guys and everyone else on this site for creating such a great source of info for such a confusing process.

I just sent in the I-130 form this morning for my husband who's in Germany. For the moment, I guess all I can do is cross my fingers and wait!!

ROUND 1:

29 Aug 2011 - Started dating

05 Oct 2012 - SO's J-1 visa expires, returns to Germany

21 Dec 2012 - Engaged in Germany
21 Mar 2013 - Married in US
26 Mar 2013 - Husband returns to Germany (again)

12 Apr 2013 - I-130 sent to Chicago Lockbox

19 Apr 2013 - NOA1 received (notice date 4/16/2013)

11 Dec 2013 - NOA2
16 Dec 2013 - Hard copy NOA2 received
22 Jan 2014 - Received Case # and IIN from NVC - we're in the system!

21 Mar 2014 - CASE COMPLETE!! (received info by calling NVC on 24 March)

06 May 2014 - interview date

16 May 2014 - POE

ROUND 2: I-751 process - just getting started!

18 Apr 2016 - I-751 packet sent to California Service Center

28 Apr 2016 - money order cashed

02 May 2016 - NOA1 received - phew!

16 May 2016 - biometrics appt

Call USCIS and request for a Tier 2 representative. A Tier 1 won't be able to do anything for you.

You're in the wrong forum (for now). This is for those that have their I-130 petitions approved and are at the NVC stage. Since you just filed, you won't be seeing a NVC thread for about another 5 months or so. I would direct you to the I-130 April 2013 Filers thread, but none has been created it seems. Why not start one?

I'll just repost my question from the other thread:

Soooooooo...we got our NOA2 on April 8th (nice wedding present lol) but it mentions in the first paragraph that "he can apply for adjustment of status". We were under the assumption that he had to go back to England when he finished this visit to do the interview etc, but if he's here and the NOA2 mentions adjustment of status, could he just stay and do that? He's been here since March 22nd and was only staying until April 17th.

Maybe I'm just being stupid and hopeful. At least receiving the NOA2 was nice.

I am confused.

I suppose I will call the nvc today.

yes, he can go forward with AOS (I-485 set + medical plus I-864)

but

he cannot leave the USA till greencard in hand.

If he leaves prior, after filing, USCIS deems the application to adjust status abandoned.

Hello all,

I have a question that maybe someone could answer. I currently have the all the documentation for the IV package ready to go with the exception of one document. My husband lived in Thailand for a year and thus has sent in a application for a Thai police certificate. However, it may be 6-8 more weeks before I receive the actual police certificate in my hand. He already has his Indian PCC as well as one from the UK since he also lived there for a year.

Is it possible that the NVC may accept our IV package with the materials we have now and have us bring the Thai police certificate with us to the interview? It just seems silly to wait an additional 8 weeks for one document.

I am the petitioner.

I was in this similar issue while back. According to USCIS if he came here as a visitor and you guys got married here in USA, you can file I-130 and I-485 for adjustment status while waiting for approval happening he can stay beyond his visa or you can filed a visa extension good idea to to so but isn't required.

Now here the catch...if you filed I-130 while he still in UK and he came here for a visit, by filing I-485 is considering a fraud according to USCIS, he must return to UK for future processing...interview and so for. You can read this up on USCIS website for more info.

Yup, it's possible. Ask for it, via letter (seperate) submitted with the DS-230 / IV set.

Like Darnell said, include a separate letter requesting that your case be closed and the Thai police certificate will be presented at the interview. There's not a guarantee it will be accepted, but it's definitely worth a shot so you're not waiting around for 8 weeks on the police certificate.
