Co-Sponsorship Needed?

Hello everyone,

We have a question about the income requirements.

Info:

My fiance (sponsor) recently received confirmation about her medical residency placement.

Last year she made well under $10,000.

At the moment she doesnt have any income because she is staying with me in Germany until her residency starts in July.

Her residency and thus employment starts July 1st. She will make $56,000 a year which is well above the income requirement.

Additionally she has over $100,000 in student loans.

We are November filers VSC so our NOA2 should hopefully arrive between mid april - end of june.

Questions:

Will the employment contract be enough during the interview to prove that I, the beneficiary, will not become a public charge although she didnt meet the income requirements in the past?

Will her student loans be taken into consideration, ultimately forcing us to find a co-sponsor?

I believe you will need a co sponsor. typically for the K1 interview you need to provide documentation showing that the petitioner currently makes at least 100% of the poverty guidelines for your household size. If it were a job the petitioner recently obtained, recent pay stubs along with a letter from her employer could be sufficient evidence to prove her income. Future income cannot however be used. Knowing this, I would say you would need to use a co sponsor. BTW her student loan debts really do not mean much of anything. They want to know how much you make not how much you owe.

According to your timeline, you might receive your NOA2 in mid May. And NOA2's validity is 4 months. Like Kastrs said, you'll need a letter from her employer and recent pay stubs. They are only asking for her current income, and even if you bring 1-2 pay stubs, I would still recommend a co-spronsor, just in case.

As for the loans, they're not interested in that.

They are concerned with CURRENT income. They do want to see your past income as well, but most of their decision will be based on the current income. If you have the interview before your fiance starts work then you cant use that income--since it hasnt happened yet. But...if your fiance starts work before the interview, then you can use it. Debt isnt even looked at.

I would highly recommend a co-sponsor, if your fiance is working before the interview and can list her income it may be enough to approve the visa without the cosponsor. Its at the descretion of the CO. But to be safe, have one ready just in case.
