Getting US PASSport for Illigitimate Minors-ANyone?

Hello fellow Vj members,

I need help or any idea for those who experienced getting a US passport for minor kids here in the US?

Here is my situation. I got my US citizenship last year and is planning to get my 2 minor kids their US passports as well.

My 2 kids are considered illigitimate since i was not married to their biological father. My 2 kids came here thru IR2 being petitioned by my USC husband .

Anyway i called for an appointment to get my kids US passport but then the lady at the post office said i need to have an original copy of death Certificate of my x?

Do i really need to? My x was out of the pic when the kids are growing up . I was a single mom (with DSWD Single Parent ID). i did not have any contact with him and did not even know the real detail of where, how and when he died?

Anybody here had a success getting passport for illigitimate minors?

What documents they u submit for proof that u have sole custudy of ur kids?

Please i would appreciate any ideas.

If your children were under 18 years of age when you naturalized, they are automatically U.S. citizens. Their citizenship is already established, whether or not you provide their biologic father's civil documents.

I'm sorry I cannot provide a definitive answer. I would definitely print something from USCIS and bring with you to post office. Many employees are out of the loop when it concerns these special circumstances.

Coz the ex was listed in the kid's Birth certificate as the father ( which is acceptable in PI). Can i not have my husband as the legal guardian of the kids since he was the petitioner anyway?

I don't think the kids will be granted IR2 visa and i will have the k1 visa and now citizenship if i was married legally before?

Your children automatically became US citizens when you did, so they are not eligible for any type of US visa.

Since the father is on the birth certicate, it looks like you have to present either a court order granting sole custody, or an adoption decree in favor of USC husband, or death certificate of biological father.

SUBMIT FORM DS-3053 IF:

You are the non-applying parent or guardian providing written consent for your minor child to apply for a U.S. passport because you are unable to appear in person with your child (Statement of Consent) or

You are the applying parent or guardian, and the written consent of the non-applying parent or guardian cannot be obtained (Statement of Special Circumstances)

First off, I assume both your kids have green cards, they do not become automatic citizens when you did, unless they have valid green cards.

Second off, while I could legally petition for my stepdaughter, I had no legal responsibility to her, if she stole a car and did a lot of damage, they would sue my wife for that, but since she was my wife, would be legally responsible for her debts. Was just a stepdad, if I kicked the bucket, she wouldn't get a cent of my SS benefits. If our marriage ended up in a divorce, I would not be liable for child support payments. To become a legal guardian of her, would have to adopt her first. Did try that, but would have to attempt that in her highly corrupt government. A six year process, and she was already too old to even begin that process.

Next issue is bringing her over here, dealing strictly with the USCIS on this information, while her father was still alive, but long abandoned her, we had to trace him down. Not only an issue with our USCIS, but the key issue was getting her permission from her don't give a damn father so she could leave her home country. A death certificate would have been nice and also a temptation for me to get him one. But as it was, he owed my wife seven years in back due child support payments, we traded that for his permission. Even got that done in a court of law. We needed that permission during my stepdaughter's AOS stage.

She was treated as a separate entity from my wife, the whole ball of wax in forms. Did have one legal responsibility to her, with that I-864 that I was forced to sign.

So how did you manage to bring your kids here without that death certificate? We sure needed that court order of permission. If you do have his death certificate, it would be far easier for your husband to adopt those kids. Could have even adopted my own stepdaughter with that piece of paper.

If you got through the USCIS okay, should be okay for applying for the N-600, I know a lot of people come here objecting to that 600 buck price tag and looking for a cheaper way by getting a US passport, but you only need that passport to travel, and really can go nuts when you look at current flight ticket cost. Do you plan to travel? To me, the price of that N-600 was nothing compared to the price of bring my stepdaughter here, and as an added benefit, became free of that crazy I-864. Its your choice, but if I were you, would get a copy of that death certificate. Anyone can do that, if you have friends or relatives in your home country.

Yes both kids has 10 yr. green card.

The kids will be automatic citizens once i become a citizen provided they meet the eligibility requirements which they did and i know i have to get either the N-600 certificate or a US passport as proof of citizenship.

I was able to bring my kids without the death certificate of my ex coz that time i raised my kids by myself and i was not married to my ex so i have the custody of my kids.

If we decided for my husband to adopt my kids . my kids should nt be here with me now coz it takes years and a lot of money for adoption especially 2 kids.

This is difficult to say, techically, the kids are orphans and US citizens as well. My nephew and niece parents were killed in a car accident when they were 2 and 1 years of age. Found a reasonable attorney and adopted both kids for around $400.00 thirty years ago. Recall the judge asking my nephew if he wanted me for his daddy, he said yes, niece wasn't talking yet. We were issued new birth certificates listing us a their parents. Whole court session lasted about ten minutes.

Since these kids were orphans, relieved the state of the burden of taking care of them, they became my responsibility.

In like manner a friend recently adopted an orphaned baby girl from all countries like Ethiopia, the child was six months old was suffering from malnutrition and required immediate medical care he could provide. Those crooks charged him in the order of $50,000.00 to adopt that child, and if he didn't, more than likely that child would be dead. If anything, they should have paid him to take that child, but you sure run into crooks in this world. Really have to watch out for those crooks, in my opinion, they should be hung.

What I can tell you, finding an honest competent attorney is not easy.

i am in the process of doing this now...I am the US CITIZEN father of an illegitimate child with FULL CUSTODY getting my child his first US PASSPORT....Will keep you all posted as to how this will develop....very nervous about the process
