hey guys,

first of all, thank you guys very much for all your help wich i really appreciated.

well, it's concerning using a co-sponsor or a house-hold member in such case like mine my wife doesn't make enough income since she works a part-time job as a student):

- in the instructions of I-864A they said that the house hod member is: "a relative who has the same address as the sponsor and is related to the sponsor as spouse, adult child, parents, or sibling"

- my wife mentioned in her G-3032 for USCIS that she lived in different address than her dad's one.

- in her tax returns of 3 recent years, she mentioned that she lives in her dad's address.

- her dad doesn't claim her as dependent in his tax return since she is independent financially.

- so the question now is:

what would be her dad ? a co-sponsor OR a house-hold member ?

Because she said she lives at a different address then he has to complete an I-864. He will be a joint sponsor.

The I-864A is handy for cases where the USC might be slightly under the limit but when combining income with their household member, meets the requirements. Your wife said she lives somewhere different, so she needs to do the I-864.

I would just have the dad submit a I-864 rather than the I-864a.

He'll be a joint sponsor.

Yur question your reffering to is probably related to question 21g on I-864. because,This question gives you the option of including certain other non-dependent relatives who are living in your residence as part of your household size. Such relatives may include your mother, father, sister, brother or adult children, if they are living in your residence. However, the only reason to include these family members in your household size is if you need to include their income when you calculate your household income for purposes of meeting the income requirement for this form. To be considered, any relative indicated in this category must sign and submit Form I- 864A. Dad needs to summits I-864 and he would be a joint sooner because he does live somewhere else and your wife is not a dependent financially with her dad. They both would file I-864, your wife as the petioner and her dad as a joint sponsor. Here is the link of the directions to I-864 it will guide you step by step on filling out the application.

can you tell me why ? what is your reason ?

and also: would it matter if her dad be a co-sponsor EVEN IF he is considered as a house-hold member ? or it doesn't matter since he can fill I-864 OR I-864A ?

If she is living with her dad he CAN use an I-864A but he doesn't have to. He is a joint sponsor either way.

As I stated in my previous response, if he completes an I-864A his income is COMBINED with hers which is good if neither income alone is sufficient but together is, for a household count of 3.

If his income alone is enough to sponsor you and himself then he can just do the I-864, and his household count would only be 2.

thank you "vanessa" and "Aidee Alcantar" for your answers :) really helpful, HOWEVER you forgot that i told you she is currently LIVING with her dad in his house. so they have the same address now BUT she just moved to live with him 9 days ago. does it matter the fact that she just moved to live with him recently (only 9days ago) ? or it doesn't matter and she can use him as a house-hold member ?

Well honestly I think it does matter because it looks suspicious.

Again, if he qualifies on his own just use the I-864 for him and one for her. If he doesn't qualify on his own then TRY the I-864A but I'm not sure that given she "just" moved in with him if they'd believe she didn't just do that to qualify for the I-864A and is moving out again. Especially when you said on one of the forms she said she didn't live with him.
