Would it be better to appeal or refile the I-129f? We sent in the missing documents and evidence and it arrived the day after they sent the denial Notice. need help please and thank you

That would mean you did not send in a timely response to the RFE. Wondering how an appeal would be won if you failed to respond timely to the RFE.

File a new petition - now you knowing your mistakes and including all required documents to get an one-shot approval. GL!

An appeal asks them to reconsider a decision as it is an incorrect decision. Their decision was not incorrect. You did not respond to an RFE, the result of that is ALWAYS a denial.

An appeal costs $590 and requires that you provide a reason that their decision was incorrect at the time they made that decision. The RFE requests information which was required initially but you did not provide. The thing about RFEs is that they do not ask for something "new or unusual" they ask for what was included in the instructions initially (this is WHY they are called "Request for Initial Evidence")

You can file an appeal (called a "motion to re-open", I-290)within 30 days of the denial, pay the fee and wait to see what happens. There are no guidelines for the time of processing an appeal.

In all likihood it will be faster, easier and cheaper to refile a proper petition after reading the instructions and being sure everything needed is provided.

Reapply my fiance and I went through the same thing. We herd nothing back from the USICIS offices of our first petition until we reapplied then all of a sudden they sent us paper work stating that our first application has expired.

Met in Morocco summer 2009

Visited again 2011, 2012, 2013
