I-129f: Missing letters of intent to marry

Hi Everyone,

I'm going to skip ranting about how angry I am at the Visa service that my fiance and I paid for and myself for not catching the error, but my I-129f petition was sent with all of the necessary documents except for the intent to marry letters. I realized this after speaking with a friend yesterday. Today I received "USCIS Acceptance Confirmation" stating that "Your case has been accepted and routed to the USCIS California Service Center for processing..." I have a feeling it will be denied because of this error, but now I assume I need to wait a few months to find this out. Are there any courses of action I can take now to either speed things up or fix this error?

If you were to mail them in now the would most likely get lost. I know it seems like a horrible option, but I would think at this pont the best thing to do is to wait for an RFE. Just make sure you are prepared when it comes

I did the same thing. When I put together my I-129F package the intent to marry letters somehow fell behind my desk....I found them like a month later. Here's what happened:

I called the customer service number and spoke with a man who seemed very helpful. He instructed me to write a cover letter explaining what happened, then send the intent letters, the cover letter, and a copy of my NOA-1 to the CSC, all the time referencing the WAC number.

I did it. About ten days later the entire package was returned to me with a form letter that basically said if they wanted something, they would ask for it. So I was pretty stressed out...first they say send the stuff, then they say they don't want it, but of course it is listed in the instructions as a requirement. So I called the customer service number again. This time I got a lady who said no, don't send us anything. If we want something we will ask you for it. I was pretty upset, getting two different stories from two different reps.

So I contacted my senator who happened to be on the Immigration Committee at the time. Her office contacted the CSC and arranged for the intent letters to be placed in my file. I don't know if they ever would have asked for them, and I don't know what would have happened, but that was the end of it. Later received an RFE for something else, but took care of it and was approved within the five months.

After all the stressing out I went through over this, I think I would recommend to just sit tight. If they want the letters they'll send you an RFE. You can overnight the letters to them and you won't really lose any time in the process, and hopefully, all will be right with the world.

That is good info to know. The more I have ready about the I-129F package errors, the more I am convinced that they get glossed over upon initial receipt. When it gets down to the end at the interview is when they seem to like to say "Oh, you are missing something"..... :bonk:

Nothing you can do but have the two originally signed letters ready when you receive the RFE, that you will in about 5-7 months.

Thank you so much to everyone that replied! This is by far the most supportive forum I've ever posted on. I'm going to have my fiancee send me her letter and sit tight until I hear back. Good luck to everyone else that posted with similar situations :) . I'll be sure to post everything that happens.

I mistakenly included photocopies of the 2 letters of intent, instead of the originals. I'm not sure if I would be given RFE for that. I'm just waiting patiently and praying that it would go unnoticed.

You are ok with that so far you include a copies just for the adjudicator to see letter.

It will not be denied, you will get an RFE.

No, there is nothing you can do until you get an RFE except read the instructions carefully and interpret literally. Obviously SOMEONE needs to.

Also realize that in this process if ANYONE makes an error it immediately becomes YOUR problem to fix. Read the instructions and be informed. That visa service is not going to do anything for the interview, the Adjustment of Status, the Removal of Conditions or the citizenship. Nor are they going to go with you to get her drivers license, SSN, enroll her in school, get a job, learn English or ANYTHING else in the process of LIFE that follows this rather meaningless visa process.

YOU need to learn about that.

Use the VJ sample letter of intent, make one for each of you, sign them and be prepared to answer the RFE.

Read about the rest of the process in the forums here and be informed as you go through each stpe. DO NOT expect the people you deal with to be informed. They are not. You will need to educate people at the DMV, Social Security office, etc. If you cannot do that your fiancee/spouse will be denied benefits everywhere they go because the people that are supposed to know...do not.
