CR-2 visa filing question

I have a Cr-2 type visa and it expires February 2014. I am planning to abroad to study this June 2013 (I won't be gone for a year only 10 months so i won't file a re-entry permit), and I would like to know if it is possible for me to file I-751 while in a different country? And if so, if an interview was required for me while I am in school, is it possible for me to reschedule that said interview when I come back here in US (I plan to come back here April 2014 during school break)?

I'm assuming your biologic parent is removing the conditions on his/her CR-1 visa. Is that correct?

If so, you can certainly be out of the country when the petition is sent. However, you will be required to do biometrics at your nearest USCIS field office. There is no way around that.

Even if you physically did the biometrics, you cannot choose how long to reschedule a possible interview. USCIS determines that.

First of all I thank you for your immediate reply, I do appreciate it.

As for removing conditions of Cr-1, I still have to ask my mom about her visa, but I think I am filing alone since she has been here for five years already (yes it took me that long to get my papers approved to come here)

So I can do the biometrics in the Philippines then?

In regards to the interview, does everyone go through it or just some cases where they find the person suspicious? If ever everyone is required to do it, then I might as well go back to the US and do the interview.

Since you entered US 90 days after your mom, you will have to file a separate I-751 application. Not every case goes to interview, so there is a very good chance that you may not be.

The US consulate in Phillipines may have biometrics facility - hope someone can give you a firm answer. Meanwhile I will search and get back.

09/12/13 - Case transferred to CSC. NOA2 received on 09/18/13

08/30/13 - Biometrics Done - No walk ins allowed at this LSC (received on 8/16/13).

08/05/13 - NOA1 (received on 08/10/13)

08/01/13 - Mailed I-751 (received on 8/2/13 - check cashed on 8/5/13)

12/28/11 - Received SSN (applied on 12/20/11, as we didn't get based on DS-230 options)
11/28/11 - Received Green Card (Expires on 10/30/13) - Welcome Letter on 11/17/11
10/30/11 - POE - Houston, TX

Chennai Consulate (40 days)
10/28/11 - Received Visa papers and Passport at VFS
10/25/11 - Interview Cleared Successfully (Spouse was not allowed in)

NVC: (90 days from NOA2 to Consulate)
08/31/11 - Case Completed (Interview 10/25/11) - Received at Chennai on 09/19/11
07/22/11 - NVC Case Number

USCIS: (92 days)

6/21/11 - NOA2 (NOA1 on 3/25/11) - took a month to get to NVC
3/21/11 - I-130 sent to USCIS Lockbox, Chicago.

AFAIK, you cannot do biometrics in the Philippines.

The biometrics appointment letter will show the closest local USCIS field office. Although you may reschedule your biometrics date, there really isn't much to change the location.

You can always verify if the U.S. Embassy Manila does biometrics for permanent residents removing conditions.

With regards to the interview, not all applicants require an interview. Only a small percentage (not sure how much). We did not require an I-751 interview.

Navyk - I do remember having my fingerprints and photograph taken there, but I am not sure if its the same they use.

Darnell - yes that is why I am researching now, so I can make a better plan, and yes I asked my dad to talk to the embassy in the Philippines to get more information in my case, I won't do anything reckless like going to a different country without making sure I can go back at ease, so thank you for your concern, I do appreciate it.

alas - embassy never get involved in ROC cases, as that's a USCIS function, not DoS.
