I130 field 13 question

Hi,

I am currently filling up I130, and im at field 13 where it ask

If you are US Citizen, complete the following:

My US Citizenship was acquired through (check one):

1) Birth in the US

2) Naturalization (Certificate Number)

3) Parents. Have you obtained a certificate of citizenship in your own name? Provide number?

Well here is my situation, I am a US citizen, born to parents who are naturalized US citizens. At the time of my birth, I was born in Subic Naval Base, in the PHilippines. I was wondering what option do i pick? I know its obvious that I pick number 3, but would there be any issue if i cannot present a certificate of citizenship? The only document I can present to prove my citizenship is my US Passport. Will this suffice?

Yes, check 3. Your US passport is sufficient evidence of your US citizenship. You must have at one time obtained some sort of certification or you could not have applied for your passport. What did you produce?

I'm a dual US/Hungarian citizen (both by birth; Hungarian citizenship verification TBA), and my husband is a dual British/Irish citizen (by treaty) from Northern Ireland. We are atheists.

Well my BC does say that I was born in the Philippines. But I was wondering if, copy of my whole passport will be sufficient? Thank you.

What does your BC say? Is it US or Phil? So, yes check "3" and include the copy of your BC.

Well, yes if it's a US Birth Certificate. (Unlikely) I would answer "parents" and then enter N/A in the space for certificate number, as there is no certificate, just passport. The OP already said their only evidence of citizenship was their passport.

This is the best advice I've read on this post. Check 3 and enter you birth certificate, it doesn't matter where it's from, there are other places on the form that asks for your passport number. Always answer the question they ask no matter what it is period.

I have a copy of my foreign birth certificate. This is what I used to renew my US passport back at the US embassy in Manila. Will this do?

I think I will submit all pages of my passport as my proof of US Citizenship.

Unfortunately, no, this is not good advice. There is no place on the I-130 or any other form that asks for a birth certificate number. This question asks for certificate number for a "Certificate of Citizenship" which nobody actually needs and few would ever pursue. There are also no places on any forms that ask for the US Citizen's passport number, ever, anywhere.

I actually havent seen any field on the form that ask for the Passport number. But Im guessing since its in the instructions, that the copy of the US passport will suffice. I am just being paranoid about things.

Yes, a copy of the US Passport will suffice as evidence of US Citizenship. You will not enter any number from any certificate anywhere on any form.

My point was to answer all the questions asked. If you claim parents you can either check yes or no. He would check NO. As far as the passport being asked for you need to read the instructions for submitting the I-130, you do need to furnish them with a photocopy of your passport and in his case a form FS-240 unless at the time of his birth Subic was considered US Territory and his parents were already citizens then he may be able to claim birth in the US

So the passport will not suffice? I really want to submit everything. And the way I have it on my application is that,

I have number three checked, since I am claiming my citizenship through my parents. Even if I had a FS-240 this still doesnt mean I was born in the US, so basically, I still have to file through my parents. Then when it ask if i "Have you obtained a certificate of citizenship in your own name? Provide number?" I will check No.

I will put a complete copy of my passport, since I do not have the FS-240, and processing that could take a couple of more weeks.

At some point your going to have to come up with a birth certificate. The instructions for the I-130 says to include it so if you don't you will probably get a request for more information

I do not like to give bad advise to anyone so would you please tell me what multiple mistakes I made so that I won't repeat them. Maybe the part about answering all questions asked, or about including a copy of the birth certificate and copy of the passport as per their instructions. The only person to mention passport number was you
