hi there my fiance who lives in the usa and is bringin me over... is now on food stamps she gets them for her and her little girl. im hopefully about to recive my interview date soon (fingers crossed). and i was wandering when i move out there can they still get food stamps aslong as i dont claim and just live of my savings till i can start my job.

If thats the case, u will have a problem. She needs to meet the poverty guidelines for 3. (U, fiancee and her daughter). Does she have any assets?

no we have a family friend sponsor that is more then enough and has know family of her own that is gona do it i just dont wana stop what my fiance gets because im coming over :)

Whos family friend? If it ur friend i dont know if that works. Did ur fiance file income tax for the past 3 yrs? Does ur fiance rent an apartment?

Basically you have to show a proof that you will not become a burden for USA tax payers, and food stamps is one of the benefits that you would need to repay for (or your sponsor will need to) in case you do get those.

I'd hope that UK is somewhat ok with financial questions, at least compared to some of the smaller countries. However her getting food stamps will be a big warning sign for the interviewer. You definetly need to prepare strong supportive case where her close relative / friend of a really long time will sign sponsorship papers, your assests would also help but they'd ask for *3 times more in assests than proven income.

She needs to meet the minimum poverty guidelines (100%) to file successfully for the Visa, and (125%) to file for the adjustment of status. This can be met by herself or with a co-sponsor. However I have to wonder how someone that can't meet the guidelines can meet the costs for the AoS. Some of these steps are not cheap. I wish you all the best of luck and happiness in your journey.

i personaly have been paying for most of the visa stuff and her its her family friend who said she would be a co-sponsor and ive got my own personal savings wich can help so its not the money we really are worrying about its that. i just dont want to lose her food stamps but i read on somones elses feed that it shouldnt aslong as i have nothing to do with it.. because living in our town is so cheap rent utilities and car insurance only comes to about 400 dollars and that was when i was living there with her whilst at school out there..

Once you are there, she could still get food stamps for her and her daughter, but couldn't claim YOU in the size of her household to increase benefits. If she received food stamp benefits for you, was somehow approved, and it later came to light, there would be the possibility of your co-sponsor being hit with the bill. Whether or not your own personal savings need to be factored in when determining her eligibility for the program can vary state to state. Better check up on that more.

Yes, maybe. No part of this process causes a US citizen to EVER surrender benefits. EVER.

However she must have a way to support you. She can do that with a co-sponsor OR their is a very narrow range of income where she could actually qualify for food stamps AND qualify to sponsor you. She needs to make 1.25 times poverty guidelines to sponsor you but can make as much as 1.8 times the guidelines and still receive food stamps.

To receive food stamps she must delcare ALL household income and assets. This means when you arrive, if you are living on "your savings" she must declare your savings as an asset and that could disqualify her for food stamps. While you do not qualify for the benefit, you DO count for income/assets.

So the answer is a qualified YES...IF she meets the requirements for food stamps AND to sponsor you.

Their is nothing in the immigration process itself that disqualifies the US citizen for benefits.
