Filing ROC with just 1 year of tax return

Hi guys, just wanted to get everybody's input. My wife's about to file her removal of conditions but we don't have all our tax documents ready to file for 2012 tax return. She's ready to file on 2/19 and we're thinking about just sending 1 year of tax return (2011). We're going to be travelling on May and we wanted to get the ROC process started right away before we leave. Do you think we'll be fine? Here are the other financial documents that we'll be sending:

2011 tax return

Lease agreement with both our names

Bank statements spanning 2 years of marriage

Personal savings spanning 2 years of marriage

Credit Cards showing her as an authorized user

Personal loan with both our names

Utility bills showing the same address

Our driver's licenses showing the same address

Copy of renter's insurance showing both our names

Health insurance showing her as part of the coverage

Car insurance showing her as part of the coverage

Copies of our trips (itineraries, photos, etc)

I would appreciate everybody's input on this.

You have pretty good evidence, 2012 Tax return should not be an issue in your case. All the best.

07/22/11 - NVC Case Number

USCIS: (92 days)

6/21/11 - NOA2 (NOA1 on 3/25/11) - took a month to get to NVC
3/21/11 - I-130 sent to USCIS Lockbox, Chicago.

I only used 1 year tax return also and my gal's ROC should be coming up for approval in about 2 more months. That is, according to the VSC processing timeline provided at the USCIS website. Also, I haven't received any RFE's yet...

You filed in June 2012 - In your case they can see that you are in a position to send them at least W-2s of 2011. Just curious to know what was your reason in not sending. Yes, it is not the only evidence and hence you may not get a RFE but curious.

08/2004: moved to Louisiana to continue study

AOS: I-130 and I-485
06/2010: got married in NC

01/2011: interview and approved

ROC: I-751
01/14/2013: Package Sent

06/12/2013: got approved!!!

06/14/2013: card and letter arrived!!!

Exactly 5 months!!! No Interview. No RFE.

Strongest Evidence? My 8-year relationship and 3-year marriage to my husband.

If it does not show commitment, then I don't know what does...

06/27/2014: Received NOA1 (Letter dated 06/20)

You filed in June 2012 - In your case they can see that you are in a position to send them at least W-2s of 2011. Just curious to know what was your reason in not sending. Yes, it is not the only evidence and hence you may not get a RFE but curious.

If my memory serves me correctly, and without taking the time to look it up, it was "optional." That is, send in [copies of] 1 year or 3 years of tax return(s) - again, if my memory serves me correctly without taking the time to look it up. I also did the same when my gal and I applied for her 2-year GC and it was not an issue/problem. Just my opinion, but sending in "lots" of evidence/information can work both ways, good and bad. "Good" for offering lots of "good" information. "Bad" for offering "lots" of evidence/information that may not look good in the USCISs eyes. But, for the record, I did follow the "instructions" for the I-751 for that time period as I know the instructions can change without notice.

You are confusing AOS and the I-864 with ROC. Totally different things.

OP - Why don't you have 2010 taxes?

8/17/10: INTERVIEW DAY (day 123) APPROVED!!

5/23/12: Sent out package
2/06/13: APPROVED!

OP - Why don't you have 2010 taxes?

I'd say expect an RFE for 2012 taxes sometime after May and have those transcripts ready to go. Last year a lot of people got RFE for taxes.

Sorry I confused... you! Perhaps it would have looked better to you if I had made a "separate" paragraph for the following as I had made it as a general statement.

Also, if you are referring to the number of years of tax returns to include... The instructions for the I-751 does not specify a number of years of tax returns to include. Furthermore, I included the statement, "If my memory serves me correctly without taking the time to look it up."

In regards to that, you might have stated that "my memory" did/does not serve me correctly.

I'd say expect an RFE for 2012 taxes sometime after May and have those transcripts ready to go. Last year a lot of people got RFE for taxes.

Isn't 2012 Tax return just 50% part of one of the several evidences of inter-mixing finances. According to me joint filing is no greater evidence compared to a joint checking account or joint vehicle ownership. Of course you can be ready to submit in case you get a RFE but I don't think there will be a RFE.

That is correct. 2011 tax return would be our first filing together as a couple. As I originally posted, we're still waiting for some other tax documents before we can file 2012 tax return and we were thinking about just sending the ROC app with just 1 year of tax return. Based on other VJ member's replies/support, it looks like we can go ahead with just doing this. I sure hope it would be enough.
